Hi,
Just looking for a bit of advice. Long story short...
My tax codes were incorrect, after speaking to the tax office (Feb) and me explaining that I have no money & am about to get into problems i was told I can have a mid tax year rebate (circa 2K, to solve all my problems). This would be paid via my employer in a payslip. First I had to give all the information to both the tax office and my employer. I did all of that as requested.
Now we are at the stage where I have a letter from both the tax office and my employer where they are basically blaming each other for why I haven't had the rebate. My employer say the tax office didn't send all the details to them so they couldn't issue it to me. The tax office basically implied that because the rebate should have been in Feb/March (they claim to have supplied all the information) but my employer is lazy and just left it for the new tax year.
Basically I am being told it's NOT my fault and I SHOULD of had the rebate.
Since then my credit card has just been ticking interest as it's impossible for me to pay it without this rebate, which I should of had. I am NOT happy about this. Tax office said I will get it around August, when it should have been Feb/march.
Basically I want either my employer or the tax office to pay this interest. Is this possible? Seems fair to me as they both say I should of had the money and it's not my fault. Is this a small claims job?
Thanks

How long has your tax code been incorrect?
Did you change jobs? have you more than one job? (you mention tax codes)0 -
Oh, it was incorrect for the majority of the year in all honesty.
I started employment just before the end of the 2012/2013 tax year with this company & it carried over incorrectly to 2013/2014. I'm not really playing the blame game on that time period. It's not been ''continuous'' employment though as it is seasonal (despite only having 1 month off) & they make sure they 100% break the contract before the next so I don't gain employee rights. So that caused a few tax issues.
But as mentioned above, when I provided all of the details to the tax office, all of that was cleared up in the information I provided, so everything was up to date.
I know some people might think that as I only asked in Feb it might be unreasonable to expect it back so soon, but i have literally JUST spoken to the tax office and they said it really should have been paid in March. They are still sticking with their story0 -
I guess it will depend on when they issued a corrected code to your employer and when their payroll cutoff date is so whether there was time in between to update the information for the tax to be corrected
Now the tax year is over the overpayment will come from HMRC. Are you claiming for 12/13 and 13/14...not sure why they think it will take till August. P60s should be complete in the next 2 weeks0 -
I notified everyone at the start of Feb & the tax office claim to have sent the details through a couple of days before the payroll cut off date. So I appreciate that there is a valid excuse for February. However, by March payslip I had the correct tax code of my payslip but my employer claim that the tax office didn't send through details of total pay to date with the number.
I appreciate that the money will come through from HMRC sooner or later. They said today if I call them up when I get my P60 they can process it over the phone.
However, that means I will get charged more interest which will be a approx £130 since I should of had the rebate. Now, this might not be much money for some people, but when you are on minimum wage that's alot. I have a loan too which is nearly paid off which I have been struggling with too because of this tax issue. That £130 is nearly a months repayment on the loan so I can't afford to lose it.0
