DCA contacted landlord Re my debt

Hi everyone.

I owed £6.95 eBay fees. Totally forgot about it as the eBay account is my husbands and he never checks the account or his emails.

Anyway, at weekend my landlord contacted me stating Akinika have contacted him on his home phone number regarding this. He gave me the ref number.

I have received no letters or phone calls to my house from them.

I contacted them and they told me to take my complaint up with eBay as they supply them with the contact details. I paid the amount directly to eBay as Akinika have charged an extra £8.

I have contacted eBay and they have stated that they have only my home contact number and have never had any other number and only passed onmy home number which they confirmed and my address to Akinika.

Does anyone know where I go from here? As my landlord is obviousley not happy he was contacted.

  • I think this was covered under the old OFT guidance as

    inappropriately disclosing, or threatening to disclose, debt details to third parties

    acting in a way likely to be publicly embarrassing to the debtor, either deliberately or negligently (that is to say, through lack of care)


    For example:
    • using postcards or other correspondence, or leaving answer phone messages (including via interactive voice messaging (IVM)), in a way which may disclose to someone other than the intended recipient the involvement of a debt recovery business
    • asking others to pass on messages to debtors, and in so doing potentially revealing to them that the intended recipients of such messages are being pursued for repayment of debts



    The new FCA rules should be the same so you can complain to them, and the FOS.


    but for the size of the sum involved I would pay it, then see if the FOS award compensation.

  • I'd report it to the ICO, as a breach of the DPA.
  • I spoke to them this morning after ringing my house 7 times since 8:30.

    Akinika admitted on the phone that they got hold of the number and contacted the landlord. They were adamant they have done nothing wrong regarding giving my landlord the reference number. They have also put an £8 charge on the account aswell which they wanted me to pay her the phone.

    They have given me details to complain directly to them but have said I will need to pay the fee regardless of me complaining or not and that they are allowed to give out the reference number to a third party.

    Seriously ?? for £8 ??? times must be hard for them, would cost more in phone calls lol, tell em to stuff there 8 quid, you don't have to pay them quat !!! they wont ask for long.

    I am having trouble with them as well. They are refusing/ unable to provide me any evidence that this debt is mine.

    They seem to be scraping the bottom of the barrel for debts....

  • Have you sent them the Prove It letter?
  • tell them to shove their £8 fee
  • Little update for everyone.

    I didn't pay the £8 fee.
    I sent a letter of complaint and received my final response today.

    They stated that they tried to contact me and got my landlords personal home number and they have since found out this was because I reside in the flat above my landlord.

    I do not live in a flat. My landlord lives in the next village.

    They stated that they were within their rights to contact my landlord due to myself not contacting them.

    I had recieved no phone calls or letters. The first I heard of it was when my landlord contacted me.

    Any ideas what to do now?
    Its appalling they contacted my landlord which they shouldn't have done.

    I'd call the FOS and see what they advise.
