Been paid late, incurred charges because of it.

Hi folks.
I was hoping to get some advice.
Work has paid us a day late, as a result I have been charged by my bank and companies for direct debits being returned unpaid.
I have been told my employer is liable to pay me for these chrages, though my employer does not believe so.
What is the case?

If your contract gives a definite pay date (and many don't) then, in theory at least, your employer is liable for any unavoidable losses this has caused you. Like any legal dispute you would have a duty to take all reasonable steps to minimise your losses. For example, using savings rather than incurring bank charges if this was an option or contacting your bank and arranging something rather than paying extra for unauthorised borrowing.
If the date was fixed, your employer missed it and you had no notice or opportunity to do anything about it then you could look to your employer to make good your losses and, if need be, sue them if they refuse.
Whether this would be a good more in respect of your job prospects or security of employment is another matter! By all means ask NICELY and, if you are a member, get your union involved but I would think long and hard before going further.
I have to say that running your finances so tight and having large direct debits so close to your normal pay day is not a good idea but may be unavoidable in certain circumstances.0 -

Thanks for the help. I did notice that the debit was gonna come out on payday, but I assumed all would be well. Lesson learnt.
But it was caused by an administrative error after a new computer system was put into place. They have admitted it was their fault.
Dont want to rock the boat, so I will ask nicely! I have not been working here too long!0 -
as mentioned on your other post it is not the system that is wrong, it is the people who are using it that are inefficient .0
