Filled P46 form wrong - I thought JSA was not taxable!

Hi!

Today I filled a P46 form and will hopefully start my new job soon. I have been claiming JSA since October so when the question was:

+Have you had a job since 6 April or been receiving taxable JSA?
+Have you not had a job since 6 April or not been receiving taxable JSA?

I ticked the latter as I thought income-based JSA was not taxable and I haven't been working.

Now I am worried, as I don't really want my new employer to know that I have been claiming JSA. What can I do now? Shall I phone up HM Revenue and tell them? Or do I have to tell my employer to change the details?

Edit: Changed mistake: P45 to P46

    Hi OP,

You will have filled in a P46 form, not a P45.

If you didn't tick the right box, just ask for a new P46, tell them you filled it in incorrectly and you'll get a new one. HMRC will know about your taxable benefits, no point you calling them to be honest.

Just fill in a new P46 form, ask them to disregard the previous one, and should be fine.
  • Ah yes, it was a P46 form!

Who do you mean with 'them'? My employer or HMRC?

My employer kept the P46 and ideally I dont want to tell them I filled it in incorrectly :(

Can I just fill in my own P46 (the first page) and give it to HMRC?

Does it make a big difference if I don't tell my employer about the mistake and only tell HMRC about it?

What does it matter if the employer knows you wereon JSA ?

Its nothing new to them. you can download a P46 or have youalready given itt the employer ?
  • The employer gave it to me and I filled it out and gave it back.

Okay, its a bit embarrassing but during the interview my employer asked what I was doing before so I lied to him and told him I was working but wanted a change of atmosphere.

It is only a simple part-time waitressing job in a small cafe, I wanted to impress and that's why I lied.. I didnt know there might be consequences :(

Well they will know from your response that you weren't working, as if you had another job you were leaving, you would obviously have ticked the first option as well...

What were you planning on doing if your employer asked for a reference from your "previous work"? It's just a really stupid lie. At any rate, just tell them you've made a mistake on the form, they won't have processed it yet most likely.

If you decide you really don't want to do this, you should wait until you've received your P45 from the job centre after you've officially signed off and started the new job. You will then be able to forward it directly to HMRC rather than to your new work and they will sort the tax out for you. They will contact your new employer with a letter explaining your taxable income prior to starting work there, but it won't spell out whether this is earnings or JSA. Your P45 if handed to your employer directly will be clearly marked as from the job centre.

  • Hi amie!
Thank you so much, I know it was stupid but I think it was a humane mistake! I learned from it.. (Im ashamed now)

Thankfully I downloaded the P46 form and just told them I made a mistake.. Hopefully it will all go well from now on.

However, I am not still not sure whether I got the job? They asked for all my forms and my trial starts in two days. Is this procedure normal?

So now Im not sure whether I should wait until I sign off?

No, the best thing is to just give them the corrected form. You should forward the P45 on to them when you receive it unless you don't want your employer to see it's from the job centre, then you can send it to HMRC.
