Oh ive had plenty of financial advice and the the verdict is unanimous, that isnt the issue, he seems to think that i need the paperwork checking in a similar way you have your passport application checked?
But he didnt seem clueless, he helped me out when i moaned a little about the fees, he got me a booklet to fill in which will exempt me from the £180.00 court fee and then gave me his direct line telephone number and said "as soon as you have had them checked, give me a ring and ill get you an urgent appointment with the district
judge"

I still think this official is confusing the 'taken advice' for 'getting it checked'
If you are confident that the info on the forms is correct and the official can offer no other clear instruction about what he means then all you can do is ask to present your petition.0 -
well in ten years in the business ive not heard of this before, and many of the SOA's received by the OR do have mistakes, obviously no one checked them and that wasnt a problem. Never heard of such a thing.
It's your petition. Quite right for a court to ask if you have taken advice and do you understand the consequences of bankruptcy - but no one needs to 'check your forms'.

From my experience seems very odd... the court clerk was the one who checked the petition papers, sat in a side room whilst she went through them all, had one page with a mistake on it which she had a blank copy of and it was changed there and then, the petition is then put before a judge, it was presented to him with a "pr!cis" form attached to the front detailing the main parts.
Thought it was pretty normal now not to even see a judge unless your petition is complicated in some way, the impression I got was that during breaks in the judges "normal cases" he/she has a look through the BR petitions.
The judge is only really looking whether you are financially fubar'd and have taken advice, the OR goes through the petition in detail and will spot any issues.every time I manage to get one more breath into this body, I will sing a song of thanks to you my brothers, my sisters, my friends, may your sleep be peaceful, and angels sing sweetly in your ears.0 -
The clerk checked mine over whilst I sat upstairs waiting for the court to open, we got there very early! The clerk came upstairs and gave me a letter with my bankruptcy number on, took me into see the judge who asked have you taken advice and aware of the consequences of bankruptcy, I said yes, he signed the paperwork and wished me luck for the future.0

Perhaps the paperwork is 'incomplete?'
Perhaps the Clerk has identified where something has been put, which might create a problem...but remember, Court Clerks are definitely not empowered to give advice.....[they don't want to get bitten further down the line by a petitioner why claims ''he said..blah blah''.....].....I think there has been a breakdown in communications too.....?
I had paperwork checked by CAB [who are currently hard-pressed...a sign that, in reality, what the Government claims about feel-good, isn't the reality?}....maybe an important section has been omitted , or completed incorrectly?No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -
Hello, just phoned my local CAB office, and they are baffled also.
Also just phoned the court clerk again, i asked him how common is it that a judge declines a petition, and he said very rare. Then he said, just get here for one today and ill get you before a judge.
So im off to court again in a wee while!!0 -
