Agency refusing to pay

Hi

My former agency are still refusing to pay two outstanding invoices for work I have done for their client and which they have been paid for.

They are stating that as the invoices were submitted outside a nominal date for the bank run they do not legally have to pay me.

The client was very happy with my work, but the agency terminated my employment.

I am not sure if I should go small claims on this?
Does anyone know what rights I have as a self employed agency worker?

    Letter before action, take them to court.

    Talk to the client to get evidence of the work being done and make them aware of the agencies actions.

    Would that be the small claims court do you know?

    They seem a bit of a cow boy outfit, they wouldn't give one girl her pay as she didn't ask politely enough!

    You have 6 years from the date of the invoice to sue, and if you have signed something to give up this right, the agency still needs to allow 30 days from the date of the invoice or else it's deemed to be unfair terms of contract and thus the clause in the contact can be rectified in court. Remember to stick your middle finger at the agency.

    I would send them a letter reminding the agency what they said to you, or even if you signed a contract, that it's not legally binding. They do have to pay up. Maybe Daisy or someone can help you draft up the letter?
