This is a terrible letter!
You first state that you are not the person the debt relates to. You then go on to quote the statute of limitations which contradicts your earlier assertion that it isn't you.
If you are not the data subject, then nothing else can be disclosed to you, so if it isn't you - you tell them and ask them to remove your details from their database. If the name they have IS you, then just because it is Statute Barred does NOT mean you cannot be chased for it - you can!
So decide which it is, and don't involve yourself in issues that have no relevance. At the moment it reads as though you are trying to find any way out of paying!0 -
Agree with Buzby - terrible letter though I appreciate that it isn't an easy situation to be in.
I would simply ignore all communication from them or send a final letter that (in one or two lines only) categorically states that you have no knowledge of this debt and will enter into no further correspondence with them regarding this matter.Personal ISA Contributions Challenge - current £0 (as at 1 April 2014) / target £15,000 (deadline 31 Mar 2015)0 -

I wouldn't even go that far with the letter.
If it's not your debt Angel, then why waste your time and emotion on it?
they have already told you that they cannot provide you with proof that it is your debt - you should consider leaving the matter there.
In fact if you must respond I would just put something like this:
I have asked you for proof that this debt is mine and you have been unable to provide it. I therefore consider the matter to be closed. Please do not contact me again.
If you want you can add something about any further correspondence will incur a charge for your time etc.
That is about as much effort as they deserve.
If the debt is truly not yours, and truly statute barred then the onus is all on them to prove that they are chasing you legitimately. You have asked them for proof and they have admitted they cannot do so - why bother with them any more?Live Positive.
