Can my old work place take my money back?

hey, i was at my work company for 8 years and loved it then we got out sourced and they promised us a billion and one things, then they just found ways to get rid of my staff and i was so depressed i had to go off sick, i got signed off for about 8 weeks and then they dismissed me in the end, now they are taking me to court for 600 pound because they said they over paid me but while off sick i was still intiltled to full pay so they haven't over paid me, I'm pretty scared because this company made me feel so rubbish at my job even though i did it for 7 years with no issues, i have no confidence and still no job, so now they are taking me to court, i have no support of anyone and i just don't know what to do, i sent all my sick notes in and kepted the receipts as they said at first they had never received them, i dust don't know what to do, I'm still very depressed from all this. please help

    Have you asked for a breakdown of the over payment?

    Is it in your original contract that you would receive full pay. Or does it say the magic word 'discretionary'


    If nothing is in your contract, then SSP is normally payable.


    They do have to prove that they have overpaid you and they also have to give you a chance to pay it back in instalments.

  • they didn't give me a breakdown they just said i can pay in full if i ring this number which i ignored then i got a letter saying the company have passed it over for them to deal with and now I've got a court letter, they are a billion worldwide company and 600 pound is nothing to them

    Whether they can afford to write it off is irrelevant, and you should not have ignored the letters. You need to ask for a breakdown of what they believe you owe, so you have something to respond to. In the meantime you need to reply to the court - there should be an option to have an additional 14 days to respond, tick this option for now but make sure you submit a full response within the extended time frame.

    Your holiday pay should still accrue during your sick period and your notice period.

    Did the company perform a proper disclipinary meeting?
  • yeah funny enough they gave me 3 in one week, funny thing is id been doing the job for 7 years not a single complaint but the company always said me and the team was well over paid. so they did their very best to get rid of me and i didn't give up till the end

    Did the disclipanaries comply with how they're described in your contract or employee handbook?

    Before you went on the sick did you use up holidays that you hadn't accrued?
