Hi guys
Im about to begin an appeal against UKCPS Ltd against a parking fine received. I've read the newbies and will be using the letter template suggested for first response to PPC's.
Before I send the letter though I just wanted to get an idea as to whether I needed to include any specific details about my circumstances in the letter.
Brief overview, we parked in a disabled bay at a retail park type thing, as there were no cars around (was a particularly quiet evening) and was stopping for a quick bite to eat, so expected to be in and out within 30 minutes to an hour (which we were).
I was unaware of any parking fine until I received a letter stating the notice relates to an unpaid parking charge, then indicates I am required to pay £100 now rather than the reduced £60 - I do recall seeing something fly off the window as we drove home, but never actually saw what it was - now I know it must have been a windscreen ticket.
Unfortunately, I do not have the receipt for the meal so am unable to send this to them as suggested in the newbie thread, although I paid on my card and so if in future am required to produce evidence that I was a customer I can do so from bank statements. The website for the retail park thing does state it is free parking for customers also.
I am not disabled and do not have a permit, but based on what I've read so far, this doesn't seem to have to matter where PPC's are concerned and we'd only parked there because the entire car park was empty - i know we shouldn't have and boy, regret it now!
So, my question is, do I need to indicate that I was a customer and that it is free parking for customers, even though in terms of evidence I can't provide them with a receipt? (Was thinking of going with something like: Parking is free for customers using the facilities, evidence of which can be provided to a court of law)
Also note, the retail park in question's website does also indicate that UKCPS operate there and states pcn's will be issued to vehicles not complying with the conditions shown on the signs around the car park.
Where it says this (below) in the template letter, I'm wondering should I remove the section relating to 'notice failed to make the basis of charge clear'? as the NTK does clearly state 'on xxx date vehicle reg xxxx was observed in a disabled bay without a valid badge displayed'.
Please issue your standard cancellation letter or a specific, detailed rejection letter. If you choose to send the latter, it must state:
- the legal basis of your charge (i.e. breach, trespass or contractual fee?) as your signage was not seen/accepted by the driver and your recent Notice failed to make the basis of the charge clear. As keeper, I cannot be expected to guess the nature of the allegation.
As for the rest of the letter, I am assuming that I just leave it as is?
FYI am still inside of the 28 day timeframe, but only have about 10-14 days left.

Do you know why PPCs continue to generate more business from exasperated landowners/retailers?
How can landowners/retailers comply with the Equality Act 2010 (the law) to provide adequate provision for those with protected characteristics if those without them unashamedly grab that provision for their own?
The fact that the car park was empty means that you had only a few more yards to walk if you parked in a 'normal' space.
All that said, we will try to help. UKCPS 'specialise' in 'misuse of disabled spaces' and are litigious, so you need to get your act together.
In terms of the question you raise, I suggest the less you say about the circumstances of the evening, the better. Just go with the standard appeal in the NEWBIES thread and see what that brings.
There has been at least one previous case that has gone to court where the Judge appeared to have made up his mind before the case was presented, that the motorist misused the disabled space, and very quickly (and expensively) found against him.Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

Thank you both, I will send the letter and see how we get on, if they reject, which I'm sure they will do - whats the stance on offering them a small amount per week? such as £1 or something, will they back off if they think they can't get anything from me? or are they likely to take it to court?
Or should I offer to pay them £60 for the original fine and advise them that's all I'm prepared to pay for my 'error'?
Also, should I include in my letter the fact that I never originally received the windscreen ticket?
Furthermore, I will never park in a disabled bay in future, I do have a stance on the matter in so much as I have never done it before, but on this occasion was late for a dinner arrangement and just parked up quickly thinking that I wouldn't be there long and the car park was empty - hence no need for concern. How wrong I was!
Also, I'm pretty concerned that you mention a case going to court and that they are 'specialised' in disabled bay misuse! Got me freaking out now so thanks for that lol

Lots of questions there - and jumping too far ahead of yourself. Don't worry about court as we can help you get this killed off at POPLA at no cost to you (but if we do help you succeed you might want to make a token contribution to a charity links to disabled people - a tenner maybe?).
And don't go offering UKCPS a pound a week (or any other amount for that matter); all you will do is flag yourself up as a 'fish on the hook' and will be likely 'ripe for a-pickin!'

Hi guys
Just wanted to update you on the progress of this appeal.
Following sending the letter to UKCPS Ltd I've today received a cancellation letter from them with no further action required. Their 'gesture of goodwill' is very much down to your hard work and I thank you for everything.
As previously suggested above, I have made a £10 donation to Disabled Motoring UK as a token of my appreciation of your help.
