When can I expect to be discharged?

Hi all,

If I was BR in May 2013, when should I expect to be discharged?
(Been good, and followed all requests from IS)

Thanks,

Matilda xx

Hi - Unless you have a Bankruptcy restriction order, then you will be automatically discharged in May 2014. There is no early discharge anymore. If you have an IPA, you will pay that for the 3 years but you are still discharged 1 year after BR....so not long to go for you then ?:)

4th of May was actual date, so no, not long at all!
I presume I'll get a letter to say I'm discharged?
    Thanks :)

No you will not get a letter if you go the full 12 months which looks extremely likely. Was you not told these things when you looked into going BR?

Not exactly true. A BRU/BRO will only extend the restrictions of a Bankrupt, not the AD date which is a year from when you declared yourself Bankrupt. (So Bankrupt 04/05/2013-Discharged 04/05/2014). Saying that, the OR can apply to the Courts to extend your discharge date if there is good reason to. I.e.- You've been dishonest or not cooperated with the OR's requests while being undischarged for example.

Yes, but I expected early discharge, as didn't realise that had ended.
Also! I was looking at how to clean up my credit report post discharge, and it said to send discharge notice to previous lenders.

No IPA, so presumably as of 4/5/14 its finally all over? (except for the lasting effects of declaring BR, obviously)

I got a letter from my OR saying I was formerly discharged but this might have been because I had ED which has no for the most part ended, it is no longer routine in simple cases like it was. You can pick up a certificate from the court which depending on your income, you can claim costs for via an EX160 I think. Worth contacting your OR and seeing if they will send you a letter, many do that for you free. That should suffice for creditors because they can find you on the register to confirm.

If you want a record of your discharge, go to the register here after discharge and within 3 months of your discharge date to print the record off:

    http://www.insolvencydirect.bis.gov.uk/eiir/

Search for yourself, and then when you find yourself in the result list click your surname in blue.

Once discharged that will show your case details and that you have been discharged and you can print it off, save the page as a pdf etc.

As said, the record on there disappears 3 months after your discharge date, so make sure you save/print it before then.

However, most OR's will do a letter confirming discharge if you request it.

    Or do both.
