Parking Eye and G24 Parking 'fines'

Hi there, I am pretty new to this so please bare with me...

I received a fine from g24 parking for parking in a retail park for over the specified period time of 6 hours (was there 7 hours in total) I went shopping at Freeport Village, Braintree with a friend and afterwards had dinner, drinks and went to the cinema, I had no idea I was going to be longer than the 6 hours as the film was longer than I anticipated. I received the £100 penalty fine through the post, reduced to £60 if paid within 14 days. The fee was issued 2nd April 2014 and I received it 11th April leaving me with 4 days left to pay the discount charge, which is not an option until I get paid next week. I have also been told to ignore and not pay this fine as they will not take any further action and parking issues are not taken into a court. Is this right or will I receive a larger fine for not paying it.

I have also received another fine from the company Parking Eye for parking at my local services which I often do, I have been there longer than 2 hours before and never had any charge forwarded to me. I go there for food, petrol and an occasional starbucks with friends as only a 5 minute drive from my house. I was there 2hours 32 minutes and have been fined another £100 when the person I was with in their car have not received a fine, how is this fair I must ask?! Again what action will they take if I refuse to pay the charges and ignore the letters?

I have also read somewhere that According to the Unfair Terms in Consumer Contract Regulations, parking charges on private land must not exceed the cost to the landowner during the period the motorist is parked there. In my case, the £100 charge they are asking for far exceeds the cost to the landowner of the parking costs which for the additional hour in both situations would be £2 extra parking, therefore I would have to be parked there for over a day to be charged the £100 fee. Is this correct in any case and could I use this in my appeal letter at all?

    Firstly, please stop calling these unlawful invoices "fines" :mad:

    For the Parking Eye ( who do sometimes take people to court ) invoice you should appeal using the template in the Newbies thread. If the appeal is rejected then appeal to POPLA.

    For the G24 one send the email below :

    Dear G24,

    This is an appeal against the charge issued to the vehicle with the registration XXXXXX, charge reference XXXX.

    It is the registered keepers assertion that :

    1. The charge is not a genuine pre-estimate of loss.
    2. The signage does not conform to the BPA CoP to which G24 has committed.
    3. G24 has no authority to issue charges over the land in question.

    As such the charge is rejected. You should now either cancel said charge or provide a POPLA code for the registered keeper to appeal to the independent adjudicator.

    Any further correspondence other than confirmation of cancellation or a POPLA code will be considered harassment and could result in legal action being taken against you.

    Please read the NEWBIES sticky thread at the top of this forum. You need to get clued up to know what to do and the is an excellent place to start.
  • Thanks Hot Bring, I sent the email to G24 and the charge has been waived.

    I am still ongoing with parking eye charge. I sent an email to the welcome break establishment explaining that I was broken down and awaiting a mechanic as an employer of the establishment informed me to do so and they are now asking for a proof of break down sheet which I have never received from any break down company (I have unfortunately broken down many times before) I also tend to use a close friend who is a mechanic and therefore not a registered company. I am not sure how to further the dispute. I am yet to dispute the claim to Parking Eye as I am still in the 14 day period and was informed by complaining the establishment itself, the charge could be cancelled. Should I also appeal to Parking Eye with the same email or appeal on different grounds such as I did with the G24 charge?

    Glad Hot Bring's letter to UKPC worked it's magic for you too.

    You should still appeal the ParkingEye charge as well as seeing if Welcome Break can sort it out for you BUT for them use the template 1st appeal in the NEWBIES thread below perhaps adding a point 4 that the vehicle was broken down.

    and take a look at the flowchart that's linked there too for a good route map of the process.

    Post it up your 1st appeal before you send it if you want the point you've added checking.

    Unfortunately P Eye won't be as easy to get rid of as UKPC and may well reject your appeal but don't worry that's expected and gets you the POPLA code
    The forum will then help you draft your appeal to POPLA - at which you stand a 99.9% chance of getting it cancelled.

    Follow Colliescarer's advice for the Parking Eye one. I'm afraid Parking Eye aren't quite as easy to get to back down but they will.

    EDIT - I think Colliescarer must have been at the communion wine a little bit early ! ;)

    Just complete PE's online appeals page with the same sort of appeal as before, or the template version in the NEWBIES sticky thread. DO NOT WAIT. PE are not to be ignored and you don't want to miss any deadline with them.
