CSA Refusing to pay back money they owe me!

CSA owe me £140 and claim they wrote to me about it and sent me Girocheques over a period of dates (for £20 each) to cover the amount!
I've not received any correspondence from them and only made a compliant recently after studying some of their letters.
I notice they're now also trying to do another job on me by backdating payments and are avoiding giving me legislation/ regulations which permits them to do this.
I'm not really that surprised they're acting in this way...It's pretty obvious they're a bunch of thieving Ba***rds!
Anyhow, what can be done about it? How does one prove they haven't received Girocheques or letters from them?
If I made a request for data will these be included in that?
Also can you request a criminal investigation be taken against an advisor?

Hello Cliffjumper,
I became a member of this website purposely to add my input to a previous thread.
My story is similar of made up arrears, and this agency not sticking to legislation. Please check the national Audit Office, and check publications by carrying out a search for Child Support Agency you need the following publication, Child Maintenance and Enforcement Commission Client Funds Account 2011-12. It makes interesting reading!
Through my own research I have found this unacceptable situation common for NRP's up and down the country.
As complaints should be remedied upon the very first point of contact within this agency, the conclusion I have come to is that they try and wear you down. I believe the alleged arrears for people are generally imposed on compliant PAYE NRP's (easy money) to make up for the CSA's financial targets.
If this is the case then this agency is acting fraudulently as defined by the fraud act 2006 and not abiding by legislation which this agency should, but generally do not adhere too.
This agencies employees are civil servants and are obligated to adhere to the civil service code of conduct, defined by Honesty, Integrity, Objectivity and Impartiality. This code is part of this agencies employees and their employment remit. If this code is broken by CSA employees then they could be held accountable for acts of serious and gross misconduct (dependent of the offence and evidence submitted).
Any communication you have with them I would advise to carry out by recorded delivery letters. Also stress to them that any communication from them is by letter and the postal service. Whilst you are building up a case against them I advise you to get your subject access request pack (information that they hold on you) a couple of times a year. In my case over the last two years its amazing the documentation I have found from my SAR from the last pack that should have been in the first. It takes time familiarising yourself with the information. If you are patient you can sift through evidence to collaborate your complaints.
Once you have your evidence, and you believe that you have clear incontrovertible evidence against these employees for acts of fraud (fraud act 2006), and acts of serious and gross misconduct. You can submit your evidence to the following department for an investigation to be undertaken against the employees concerned in relation to your evidence. Send copied evidence only. Keep the originals for your own records.
I hope this information helps people to find closure, the department is,
Internal Investigations
Finance and Commercial Division
Department for Work and Pensions
Room BP9251
Belsay House
Benton Park View
Longbenton
Newcastle-upon-Tyne

Regarding the missing cheques, they should send you a form to sign to declare you haven't received them. They will then conduct checks to confirm the cheques haven't been cashed. Once they have done that, they should reissue the payments.
Regarding the legislation for backdating payments, there are different rules for different situations. If you provide more specific info about what exactly has happened to lead to backdated payments, I can probably find the relevant legislation.I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.0
