Hi
Sorry if I'm posting in the wrong place... after some advice regarding a debt from 2010! My husband had an MBNA credit card and set a DD up over the telephone, several months later we discovered not one payment had been made so when we raised this as a complaint and took it the the FSO, upon investigation all phone calls and notes had "conveniently" disappeared. We received a letter from Experto Credite to say they had bought the debt and only ever received a yearly statement from them but yesterday a letter arrived from a company called HL Solicitors (Verde) who claim they are acting on behalf of their client Experto Credite and are demanding full payment of around £3500 within 14 days and will take legal proceedings failure to do so
Anyways guess I'm trying to ask what u would do in this situation, I'm pretty sure we didn't receive correspondence from MBNA to say they have sold the debt so it's like someone walking up to me in the street saying I owe the X amount and paying a stranger? If we can on ignoring all letters so there's no acknowledgement of debt what do u think would happen?
Hope someone can advise please?
Thank u

You would either get to the point where there has been no acknowledgement of the debt for six years, and it would become statute barred.
Or they would act on their threat and take court action before that.
The former is more likely than the latter but the latter can't be ruled out.
Is this part of a bigger debt picture?0 -
Send them the prove it letter if its the first time you have heard from them.:beer:0

Agree with Happy-bunny, send provit letter, always best to communicate in some way with them, as this will automatically put the account "on hold" until required proof or otherwise is provided.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
