Court claims and POPLA

Hey so I have read through the stickies and also bought the parking prankster guide, I'm just a little confused, I am writing to the court to say I am defending the case and Im writing to the land owner, do I also dispute the case with parking eye themselves via their website in order to try and get a POPLA code or is it too late for that?

    What are you using as a defence ? Have you looked at the parking pranksters ebooks on this?

    You need to give us a bit of a timeline of events.

    There's no reason why you can't appeal to PE (if you've not already done so) and ask for a POPLA code as POPLA is the official ADR (Alternative Dispute Resolution Service) for the private parking 'industry'. This will save the Courts unnecessarily becoming involved as POPLA can provide a very similar service. This will bode well for you if this does get to the Small Claims Court, that you have tried to resolve this to save troubling the court.

    The other side of this coin is that if PE refuse you a POPLA code, the court might not look particularly favourably on them.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

  • Basically the camera has caught me coming in and out of the car park on two trips in the day when checking the surf and has registered it as one long stay. I changed address and all of the letters have been going to my old house, now I have a giant stack of letters including one from 7 days ago from nothhampton court a legitimate claim form, does that make it too late for an appeal directly to parking eye? Also it seems the signage and camera positions is not up to BPA standard in the car park in question according to parking prankster if its not too late to appeal should I throw that into my appeal to PE?

    You've got to do this in order, first acknowledge the claim, say you will defend in full and ask for 28 days to defend this, and don't contest jurisdiction. Then go to the link below and learn how to do a defence, 2 ebooks one free the other a cost of a pint get both

  • okay cool so no POPLA and no direct appeal to PE? Ive already bought the book and have read most of it, and also am going to contact the car park owner and see if he will help me out with a letter. Is there anything else I can do? Thanks for your help its much appreciated

    Follow the advice in post 3 , make complaints to the landowner and so on. But please ensure that a defence is lodged within the timescales.

    I would also write to Parking Eye personally, being really assertive and proactive, and copy in the landowner and/or retailer or anyone you want to hear your wrath about this scam. I would ask for POPLA and I would tell them they have no prospects of success so may as well drop the case anyway. Point out the case they just lost regarding the same issue (two visits). It's in the 'small claim cases won by defendants' link, in post #5 of the NEWBIES thread. Hope you've read it already, TBH, because that's why the thread is at the top and why it says to 'read it first' even if your PCN is old or new. There are loads of links and advice in the NEWBIES thread, post #5 for your case.

    I won't post a link to the recently won case I am thinking of as it really is easy to find, linked in the NEWBIES thread, and you need to find your way around this forum as a fairly steep learning curve, to get the info you need and it's easy when you know how. You would also do well to read lots of other Parking Eye Northampton Court case threads, easily found on here and on pepipoo com by search for 'Northampton' as a keyword on MSE and on this pepipoo forum here which has LOADS of cases where people have been there, done that, beaten ParkingEye or got a low offer accepted:

    You will need to be ready for the stupid 'pay us £50 as we are out of pocket as we have spent money on letters because you ignored us' rubbish that they always send if a landowner/retailer tells them to drop it. There is NO NEED to ask what to do about that letter as it's covered endlessly in other threads you will read!

    P.S. You do realise you don't 'write' to the court to acknowledge the claim, you just register on MCOL and do it online? And it's ONLY a case of acknowledging first, then you write the defence to follow it. Then you have to work on a defence (you don't get a letter in between and you only get 28 days plus a few days for service, all told)? DO NOT rely on anyone telling you the case 'will be cancelled'. DEFEND ANYWAY.

    P.P.S. I can send a defence to you but I will never do that until I know a poster has read around a lot. Also I am about to disabled pm's until the Easter weekend as I am off away again for a few days to Newquay so I won't do it now at all. Send me a pm next week once you've sussed it all out!

    You could pop next door to Tower Road at the same time (don't confuse the two as they really are next door to one another) the pic on my thread was taken at the sign above the ticket machine (which I uploaded on here), so it would be useful to see the rest of the signs!!
