Another job whilst suspended?

All,
I have recently been suspended on full pay pending further investigation from a company I have worked for for nearly a year. I love the job and I'm now bored out of my mind and just generally going insane without work. The investigation is not work related, it's an alleged criminal offence that I did not commit and I am confident that in due course I will be cleared and reinstated into my job. But this process could take months. I have been offered some work with another company who know about the alleged offence and are happy to take me on whilst I am suspended.
Is this fraud or just morally wrong. I don't want to lose my current job and I don't want to get myself in any more bother...

Whilst suspended you are expected to be available for work, taking another job would mean you are not. Are you being paid whilst suspended?0

Go in as a consultant / contractor with flexible hours. If the other company is aware If the situation they will probably very OK with it. Current employer might just sack you though0 -

Suspension is a neutral act and you are meant to be avalable to return to work at instant notice. If HR did the letter properly, it would tell you this.
Your contract should have clauses about other employment - if it's prohibited, then you shouldn't chance this - it would be gross misconduct and a dismissible offence.
if it doesn't say this, then you may be able to bluster through it and tell them they never said you couldn't work for someone else. TBH, I think you would be on dicey ground anyway, as if it's the hours you normally work for your main employer you couldn't really just walk out and deny it.

Your normal contract conditions will apply, you need to check them for the restrictions on working elsewhere, while not contracted on your current job
A total ban is not reasonable but there are often restriction like you must notify and aget permission
It would need to fall outside your normal hours and be non competitive.
A lot of people take on work outside their normal employment and "forget" they should comply with contract, things like being on a committee is other work even if not paid.
The reality is you are probably going to put your current job at risk unless you can keep it under you hat.0
