Capquest and CCJ?

Hi All

my debts are just at the statute barred stage give or take a few months. Out of the blue have capquest chasing me threatening to take me to court.

They have sent me a letter that Capquest investments has purchased the debt. Do they (Capquest) apply for and go through getting a CCJ or is it just a bluff?

I would like to make a settlement offer but don't want to restart the clock, but at the same time don't want a CCJ, especially as the debt defaulted in 2009 and will come off my CRA next year!

    It is certainly possible that they may actually try to commence court action and sometimes do.

    But they like all DCAs threaten court action many times more than they actually do take it, and threaten it when they don't have the correct paperwork to prove the debt etc.

    How much is the alleged debt?

    If they did successfully take court action would you be in a position to pay the debt in full within a month (so they CCJ would not be recorded on your credit file).

    The debt is around £16k. IF they did get a CCJ I wont be able to pay but would argue in court and look to pay £1 as I really could not afford it.

    Debt is 5years old and now owned by Capquest, how much do you think they will accept as F&F?

    You could try and wait it out, if its close to the 6 year limit, or you could ask them to prove you owe the debt, link here :

    £16K they will be looking at ccj or bankrupcy I would imagine
    Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.
