Splitting up with partner & will receive more tax credits

Hi All,


I currently live with my partner in his house and we have two kids together. We are at the end of our on off relationship at present and he is looking to move out and leave me in his house with the kids.


He has been BR since last summer however I only went BR in November.


Right now due to our joint income and expenditure my OR does not take any payments from me on a monthly basis. I've also recently went back to work and having to pay a nursery fee for our baby I am even worse off financially than when I was on maternity leave when I went BR initially.


However I've looked into tax credits and if I am a single parent working PT with my two kids I will receive quite a lot of tax credits and therefore be deemed to have spare funds to start paying back my liabilities via my OR.


Is this what will happen? I'm also worried they realise I can now pay and extended my BR to 3 years by making me pay for this time as opposed to being discharged after 12 and paying nothing back.


I'm also worried that they can ask me to move as the rent for my partners place would be quite high (he still needs to pay the mortgage its a 4 bedroom house) so how would that play out?


Appreciate any advice.

    He will also have a change of circumstance and have to inform the OR. I doubt the OR will allow him to pay the mortgage on a 4 bedroom property he is not living in and rent another property.

    You would now have all the running costs of your home so you may find that your outgoings are higher.

    As tigerfeet says, post your SoA and people can advise. It may be that you both need an honest discussion to see if you can afford to live apart at the moment and may have to to delay actually living apart until bankruptcy has finished. With a 4 bedroom house at least you have the room to live separately together.

  • Bankruptcy is a complication, but you and your ex need to face the realities of life. Is it possible for him to rent somewhere and pay the mortgage ? If not, then the 'rule of thumb' that whoever keeps the children gets to stay in the matrimonial home doesn't apply because it is simply not affordable. I assume there is little or no equity in it given you have both gone bankrupt.
