    This means nothing without the context of when demand notices, reminders etc were issued. You need to know how the rest of council tax billing works.

    Anything that changes the account would generate a new demand notice (and assuming it wasn't already subject to a summons) start the action again from that date.

    Before writing to the council asking them to quash the order I would suggest that your better off asking for a list in writing of all the action taken and the dates the notices were issued. The ombudsman would't deal with the case until you've gone right through the process with the council (even then the ombudsman can only make a suggestion to the council, it's not enforceable).

    The recovery officer I spoke to when I asked why now, said the order had just been sitting around on a desk. I left the property in July 1999. I have just learned of this debt over a week ago. I have not been in hiding on Mars.
    Are you now telling me that I have just wasted my time looking into this??

    That's far too simplistic an answer without full details of the case.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    Are you telling me that I have just wasted my afternoon looking into this??

    Not necessarily but you need a full breakdown of what has happened and when before you can determine if the order was issued correctly or not.

    OK CIS,
    Do I just ring and ask for a list in writing of all the action taken and the dates the notices were issued, or do I have to make a written request? and then if I do get it what then?

    Any format should do - ask them for confirmation of the dates of the demand notice, any reminders/final notice and the summons for which the liability order was granted.

  • Sorry for the big delay in getting back to this thread.
    Since my last post, I did ring the authority and asked for all of the info. They told me that they couldn't supply it as it was all done before the new system was put in place, and that they would be in touch.
    After hearing nothing from them for months, someone had been out to my house yesterday, and pushed an assessment of means through my letterbox, along with a card telling me to ring them within 7 days!!
    I have just come off the phone from them and spoke to a team leader. I explained about obtaining the liability order in error and he agreed. He also said they would get the order quashed as they cannot pursue it. I asked for confirmation in writing.


    I don't hide from debt. If this order had been done correctly I would of paid it, no problem.
