Question ..Working Tax Credits

I phoned up the taxcredits place to inform them that i will be getting married shortly , my fiancee is Canadian and spends time here and back in her home country , i wanted to do things legally as i have an ex mother in law who would do anything to spoil things , they stopped my taxcredits and even tho nothing has been sorted out yet they have put in for a National Insurance number for her which she wont get as she spends few months here and goes back home (we haven't got that far yet) ..i have tried to explain to the tax credits that she is only here for now another few weeks but they wont reinstate the taxcredits and they say its illegal to do so .
I only wanted to do things legally but it has left me so financially screwed i have had to resort to payday loans to live , this has been dragging on for 3 months next month she goes back to Canada all i need is my tax credits back what went wrong i expected them to make a note she was here etc not to ban me from claiming .. i have nothing to live on ... can anyone help me with what to do.....

But we aren't yet ..... As she isn't living here full time and even tho we are engaged this has held everything back ..... what do i do they said i can't reclaim as its illegal ..how.. she is going back next month its the same as having a friend visit surely ........ wish i never bothered telling them now0

She lives with me .. but only for the stated periods... before she goes back home for 6 months ..We wanted to get the wedding over and done with this time before she went back but for financial reasons that wont be happening this time ....0

Not child tax credits , my children are all grown up and left home some time ago ... Couldn't go thru all that again lol0

Excuse me butting in Blond Bubbles because I know this is your field of expertise but would the kind of visa that his fiancee has be anything to do with this?
OP mentions that they were going to get married but couldn't due to financial reasons.
Was this a visa where you were sponsoring her and had to show that you could support her or was it is a visitor's visa?
Am just thinking if it was the kind where you have to show a particular amount of income as regards sponsoring whether HMRC have picked up on this and are querying the criteria for the visa.
May be totally nothing to do with this but the use of the word 'illegal' made me wonder.0 -
Nope pmlindyloo it was a visitors visa .. bit at a time we are chipping away at her living here full time properly . Her grandparents were British and eventually we will be going down that route ..Her visa states no access to public funds so i wasn't expecting financial aid for her staying here .. i just wanted to notify the HMRC about the situation as my ex inlaws aren't nice people0

I thought until we are married or living together properly instead off her spending a few months here then going back home i would not be penalised or forced into splitting up permanently for financial reasons .. all i wanted was a note put on my records that eventually there would be a joint claim when she moves in once her visa was sorted.....0

i think her visa says 2 months then she goes home for a period before coming back here it could be 9 months before i even see her again .....0

We have been dating now for 10 yrs and always she comes back and fore stays for a bit goes home again ... but like i said my ex-inlaws found out i was dating and they only need a reason to try and stick the boot in..0

I did disagree with their decision ..But they said it was correct ....................***is subject to immigration control, but whose circumstances are covered by any of the sections below*** what's this bit i wasn't expecting extra cash for her , i told the HMRC that already but i never saw that maybe its a way of getting my normal taxcredits back0

Just found the legislation myself
So how will they assess the joint claim? Do they take any income she earns (presumably elsewhere) or just the OP's financial circumstances?
Can't see why they have taken 3 months unless the OP is insisting that it stays as a single claim.
Why can't they just explain in simple terms how this will affect his claim?0
