Drydens Fairfax/Citicard/Capquest

Can someone help me please? Out of the blue I recently received a letter (dated 12 March) from Drydens Fairfax saying I owe CapQuest £3143.57. This apparently is because I made a credit agreement with Citigroup and failed to pay it. The debt was then sold to Capquest. I did have a Citicard prior to 2007, and I think I paid it off a very long time ago (also prior to 2007) but have no documentation. As I thought the letter was an error I ignored it, but today I have received a Northampton County Court Claim Form showing Capquest as the claimant, Drydens Fairfax as the address, and I have 14 days (from 28 March???) to repond to the claim.

Until I received this letter I have had no dealings with any of these 3 companies whatsoever. I have checked my Equifax credit report and there is no mention of the above debt, no any record of any searches by the above companies (I have moved house 3 times since 2007).

Don't know what to do - please can someone give me some advice. Thanks.

    Urgent CCA request to Drydens, respond to the court claim disputing the debt, ask for proof, say you know nothing about it, there will be a form to do this.

    If the issue date is 28 March, it is deemed to be served 5 days after that and time runs from then.

    If you require 28 days rather than 14 then acknowledge service (do it online) stating that you intend to defend the claim in full.

    National Debtline have an info sheet but you have to phone them for it

    Sounds like the debt may not be yours but even if it was it would be statute barred under the Limitation Act 1980

    A cca request is not relevant to that defence.

    You say you didn't have any dealings with any of the 3 companies, however you also say you held a Citicard which is/was part of Citigroup.

    You need to send an SAR but I am not sure who would send it to.
    I don't know about All About Debt, but there are actual lawyers on CAG. And Fatbelly may also be a lawyer (I don't know). His advice is certainly well qualified and I would have complete confidence in taking his advice myself.

    The OP should be aware of the timescales for a SAR vs the timescales for the procedure to defend the application. The OP should therefore not rely on just the SAR.
