Any grounds to take legal action ?

Hello there I'm new to the site ,I was applying for a loan and although I was unsuccessful I was prompt to another site loandirect.co.uk to put my card details as thought I was accepted at their site ( Which I did ) and I then got redirected to their home page saying that I had to pay £69.75 for a one off membership fee, which I then hurriedly telephone the company to cancel my account and to stop any future charges of my account which then the lady on the telephone said she had done. But then on Monday when I went to check my account I was shocked to see the £69.75 went out, I felt really angry and let down as they said they had stopped my account and the one off fee.

Now a week later my bank was charged again by a company called creditmaze ( Who I had no dealings with AT ALL, I didn't even know who they were when the lady at the bank told me ) I phoned them up and asked how on earth they managed to get my details and the lady on the phone said that Loansdirect gave them to the company( Now I'm not sure on the law but isn't that illegal to share a customers details with another company without their say so? )

THEN believe it or not the company CREDITMAZE THEN shared my information with a company called Credit Cleaner, yet again I did not know who they were, did not do any business at all with them.

I'm so angry at the moment and really scared that this will keep on going do I have any grounds to take legal action at all for the company's sharing my debit card details any help will be thankful as this is the first time that this has happened to me.

Many thanks

Lewis.

Probably not. What the t&cs say about passing on your details?

Have you applied for a refund?

If you have been refunded, what loss could claim?

No, they are loan brokers, you agreed to them sharing your details with their "membership partners" (read the non brokers who are actually lending the monies).

You no doubt agreed to them sharing your information when you accepted the T&C's......

Small claims court for what ? What losses have you incurred ?

    Whats "protection information" ?

I bet its in the T&C's you agreed to when signing up.

You clearly didn't read and understand what you were signing up to.

So you will have missed the bit authorising them to share your information.

I appreciate some people are not great at reading T&Cs and happily enter their card details on various websites but surely having a clause saying once we have your bank details we can pass these to all our friends and rivals who can charge what they like when like unless you track them down and convince them to stop, is totally unfair as a contract term.

We see a lot of threads on here where a person naively entered there card details on one brokers site and suddenly they are hit with various charges from companies that they have never heard of.

Loan broker fees are bad enough but what's to stop one of these companies setting up a whole load of 'sister' companies and charging over and over again for every new punter they snare?

Just because it is in the T&Cs does not mean that it is legal.

It really is an evil business model.

I cannot believe that various layers of regulation and legislation haven't yet triggered the banning of this practice.

If anybody wants their day in court they might win an Unfair Contracts test case. Alas, the typical person to be entrapped won't have the money for the first 10 minutes with a solicitor.

In the meantime, don't put your card details into a web site without first understanding what you're agreeing to.
