Why would they mention being willing to make the wage up? It essentially means there's no bonus associated with the first quarter of the bonus target.
If, as you said, it's a large firm, they're unlikely to be paying under NMW. If she starts the job and finds she is actually paid under NMW, HMRC will investigate if she reports it.

Agree for main part with feedback you have received.
Just a couple of observations.
1) Re above. Amiehall is right, but it generally takes the HMRC ages to investigate, and the threat thereof would hardly assist employer/employee relations. A simple matter such as this can be resolved informally.

have now..... there it is in 1.1 the first part of the legislations
A person who qualifies for the national minimum wage shall be remunerated by his employer in respect of his work in any pay reference period at a rate which is not less than the national minimum wage.0 -
Employers are legally obliged to ensure you receive at least the Minimum Wage for every hour you work, though they can use commission as a means of making up this rate of pay.
OTE = On Target Earnings
OTE = Opportunity To Earn
You either have one month or three months to show you have the ability to meet these targets in order to cover your pay otherwise they will pay you the minimum and then ask you to leave.
However, you need to read the contract carefully and if you are unsure then you need to ask for some professional advice as to how this really works.0 -
It will be the case if the employee can not perform well enough to make the targets to earn the nmw then nog much chanceof them being employed there for very long.0
