1. Get someone round to kick your uncles asssssss
2. Get down to the Halifax with your gran, ask to see an advisor, get statements etc from the advisor, so you know ACTUALLY what is going on.Breast Cancer Now 100 miles October 2022 100 / 100miles

I dont normally condone violence, but that kid does need a good kicking until he is made to repay every penny.
How can a human being do that to their own mother, makes me sick!!0 -
She should be claiming pension credits, including full HB and CTS. If she is claiming these and is still struggling to pay it sounds like she could also do with some budgeting help.0

'The kid' wanted the loan, the kid should make the repayments.
I think if it was me I'd allow it to go to County Court and then go along and explain it all to the judge. And make sure the local papers and everyone knew 'the kid's' name and what he/she had done.
PS: You cannot be discriminated against on grounds of age in financial services. How is the lender to know she only has pension income - she might have been a very wealthy woman who could well afford it.
No, they can't discriminate because of age but they can and should discriminate on the basis of whether the person can repay the loan or not.
If your Gran really wants to do something about this then she, with perhaps you with her, need to make an appointment at the bank and go along and explain the circumstances.
Maybe she thought she was helping out by getting the loan at the time. Perhaps other relatives should be putting pressure on your uncle to repay her?0 -

Hello there,
Based upon the limited information given so far, a DRO (Debt Relief Order) could be an option. Although there may be scope for challenging the debt it could be long-winded, and ultimately such a challenge may not end up with a favourable outcome. The qualifying rules for a DRO are:
- be unable to pay your debts;
- have total debts under £15,000 at the date the application is approved by the official receiver;
- have assets below £300;
- not have a car or motor bike worth more than £1,000;
- have less than £50 a month spare income after normal household expenses are taken into account;
- live in England or Wales (or have lived or run a business in England or Wales in the last three years); and
- not have had a DRO in the last six years.

Is there any way she could get a settlement figure and just pay it off? Sometimes old people have money stashed away that they forget about.0

This isn't the ethical thing to do, but it is what I would do as well. Just don't pay it. She is 86 living in a council house. What can they do to her?0 -

I agree.
On the point of ethics I'd be having a physical chat with the son, but I suppose that's not really legal.0 -
