Very Old Debt, Debt Collectors Threatening Me

I hope someone can help. I recently applied for a mortgage, everything was fine, however I have had 2 debt collectors come out of the wood work claiming I owe them.
The first debt originated in 1997, I was 15 at the time, so clearly they have the wrong person, however the second one that came this morning was sent to my mums house, in my maiden name, and they claim the debt is a store card. I don't recall having a card from this store but I'm not sure, but they say that as the debt went to court in 2004 and a CCJ Was issued, it isn't statute barred and they need to establish if I owe the money.

My credit file is clean as a whistle and I'd like it to stay that way, but they are claiming they will issue a new default, send debt collectors etc, and I'm really worried.

Can anyone help me?

    They can't issue a new default. Tell them to sod off.

  • I also don't understand why these have suddenly appeared since I applied for a mortgage.

    The first debt collectors are insisting I owe them, even though I was 15 when the credit agreement was taken out, but it's just the fact the guy was so forceful when he said a CCJ had been issued therefore I had to pay, and they could put a default on my credit file again. He even told me they'd take me back to court to get a new CCJ if they needed to. But I genuinely have no recollection of this store card yet they are absolutely certain the debt is mine.

    Debt collectors lie through their teeth. They can't put a default on your credit file again. They can't get a new CCJ. Even if it was yours, which it seems it isn't, they couldn't even enforce the old CCJ without permission from the court, which they would never get. It's just a complete load of bullcrap.

    Ignore - or write telling them that it's not your debt, that you will oppose any attempt by the to enforce the CCJ and that if they try to put a default on your credit record you will report them to the ICO, take them to the FOS and sue them for defamation and consequential losses..

  • So they've obviously written to me in the hopes they'll scare me in to paying?

    I wouldn't have been so bothered about it, but it's the fact that I'm buying a house with my husband at the moment and we can't afford anything to hinder the process.

  • have you sent a prove it letter, template on the site somewhere. that normally stops them and make them crawl back into the woodwork
