Gladstone Letter (Previously Roxburghe & Vinci Parking)

Hello all,

I was wondering if anyone could assist. I just received a letter from Gladstone Solicitors, following a parking fine, and I've been pouring over all of the links and templates and I'm genuinely unsure which one applies in this instance.

I appealed to the PCN but received no response, and it went straight to Roxburghe. I sent letters denying the debt to Roxburghe, and to not contact me, but have not been given any opportunity to go to POPLA. I have the receipt for having actually paid for up to 24 hours of parking (I stayed for 8).

I was considering sending the letter from the MET parking charge/gladstone solicitors thread as written by Daisy to Gladstones directly, as it seemed to be the closest applicable, but wanted to get some advice first.

Hopefully someone'll be able to point me in the right direction.

    Okay it's likely you've only been dealing with roxburghe all along, did you appeal to paymypcn ? If so this is roxburghe! Gladstones letter does it say they are acting for roxburghe and to contact them for payment etc? Because if it does these are roxburghe as well writing as solicitors by renting the headed paper.

    Can you redo the link with just the http://www taken out, it's to complex for me to work on it with my phone

    Never ignore a solicitor's letter, especially a letter from the litigation department (albeit a computer generated template letter).

    I suggest that you send the letter on mnkut's thread, but amend it to reflect your own circumstances - ie that you paid for 24 hrs parking (enclose a COPY of the ticket) so you do not owe any money at all, and their client has not suffered any loss. Further, you made a written appeal to their client within the specified time (enclose a copy of the appeal letter, and the proof of posting if you obtained one) but that their client did not reply and did not supply a POPLA code to enable you to appeal to POPLA.

    I would also copy the letter to Roxburghe, tell them the alleged 'debt' is disputed and that they must cease and desist contact with you, failing which you will report them to the Credit Services Association

    I suggest that you also complain to the BPA / DVLA about Vinci's failure to deal with your appeal and/or supply a POPLA code, explaining that you did in fact purchase a ticket (again, enclose a copy of your appeal to vinci, and a copy of the ticket purchased).

    Finally, COMPLAIN to the landowner about the actions of their parking agent in sending solicitor's letters to you about a non-existent debt (again enclosing copies of the ticket, PCN, appeal, and solicitor's letter).

  • I did appeal to paymypcn, but never received any response regarding my appeal, or a reference to go to POPLA. The next letter I received from them said I was out of the appeal period and that I needed to pay now. I've been denying the debt from the word go, and was surprised that POPLA was skipped entirely by them. Which is why I'm so confused about which direction I should proceed in now, because it's not following the order in the sticky thread.

    Gladstones in this case are acting for roxburghe, they are doing the same thing as Graham White and renting headed paperwork, I would bet my house on gladstones not even being aware who this person is as it all comes from roxburghe.

    Sometimes you are to solicitorty ;) still no harm sending that letter

    Thank you. This is incredibly helpful information! The only difficulty I might have is providing a copy of the appeal, as it was done online through paymypcn. Is there a way to retrieve this now?

    Yeah... I agree. But since the letter is on Gladstones letterhead, the firm is solely responsible for the content. Anyone receiving the letter is entitled to assume it is from the solicitor's firm itself - and the firm will carry the can if the SRA get involved.

    I haven't seen the letter, but if it is Gladstones in Knutsford, they are a real firm of solicitors with 'proper' clients. They should be shot for getting into the 'rent a letter head' game.

    Can I ask though about this letter which is now added to the thread, there's got to be something wrong with the fact that roxburghe are using this letterhead to mislead people into thinking that a solicitor is writing to them not a debt collector.

    Surely that has got to be deceptive behaviour? Surely the the SRA couldn't endorse that behaviour? Or am I being naive with this and it's common practice with law firms?
