Please can anyone help? I've received a small claims notice for our sherif court, regarding a credit card I had 2006. It was with vanquis but they've sold debt on to Cabot who've issued summons?
Is it too late to stop this now? What can I do? Please advise? Thankyou

Hello there,
If you wish to make a formal request for information under the Consumer Credit Act, here's a link to our sample letter: https://www.nationaldebtline.org/S/sampleletters/sole-letters/Pages/Information-about-instalments-still-to-pay-under-a-credit-agreement-%28sole-name%29.aspx
Can you remember when you stopped payment towards the credit card? How much is outstanding? Are you looking to admit liability or defend the claim?
Here's our fact sheet covering court action in Scotland: https://www.nationaldebtline.org/S/factsheets/Pages/05%20SCOT%20Sheriff%20court%20action%20for%20debt/Default.aspx
Hope you find this information useful!
Best wishes,

How long ago did you last pay towards the debt (or use the card)? Was that 2006 or is 2006 the date you took the account out?
In terms of the CCA request - you can send one at any time if you want to see if they have a copy of the agreement. A CCA request under the Consumer Credit Act only means they have to produce a copy of the CCA or reconstituted copy of the CCA not the signed original.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
