Hi,
I sent a cca request off in october 13 to moorgate re my old mbna debt to which i got no response,i continued paying until march when i sent off the origional request along with second letter stating i had not yet had a response and would stop payments until i got one.
They then sent me out (along with bombarding me with calls) my "signed contract" however no where on this is my signature just 2 tick boxes that say i agree to t and cs and someone has hand written my name at the top.
My bf says thats a general letter they send out and that it doesnt stand as cca is he right or would they be able to take action on me with this if i refuse to make any further payments?
Sorry a bit lengthy i know!!
Any help gladly taken!

Hi,
Depends when the account was taken out, if it was pre-2007 then no, it would not comply, for any agreement dated prior to April 2007, to fully comply with CCA1974, they must provide you with a copy of your agreement, signed, and it must include ALL of the prescribed terms, ie, interest rate, credit limit etc etc, on the same document.
However, after April 2007, the rules on this were relaxed, so depends when your account was opened.I’m a Forum Ambassador and I support the Forum Team on the Debt free wannabe, Credit file and ratings, and Bankruptcy and living with it boards.
