I received a PCN from parking eye
I had as far as I was concerned paid by text, I've had confirmation (and a copy) from my mobile provider that I had text them
So do I mention this in my first appeal letter or hold it back for now?

It won't hurt to mention it (but make sure you do it in such a way that you cannot be identified as the driver), along with the other matters covered in the template appeal letter in the newbie sticky thread.
Before you do that though:
1) Was this in England or Wales?
2) Was it a notice through the post or attached to the vehicle?
3) Are you the registered keeper of the car?0 -
You could to them, but the next step POPLA do not accept payment as an excuse.

POPLA do not accept matters such as payment (whether successful or not) as a defence. The side on the Parking Company's side that it was unsuccessful or the wrong vehicle registration was input etc, in the same way they do not allow appeals for pay and display tickets that blow out of view etc.0

In that case then just send the template appeal from the Newbie sticky thread. Do not identify yourself as the driver. If you want to include the payment thing then you can, but it will make no difference, ParkingEye will reject your appeal regardless. Appealing is just a way to get a POPLA code for a POPLA appeal, which if you use the guidance on this forum you will win.0 -

Unless you are prepared to drop the fact you paid and start reading the stickies, you are not going to get very far.
It is not about right or wrong or injustice.
The parking firm will ignore the fact you paid, so Will POPLA
However POLA are backed in to a legal corner on a point of law and this can be used against both of them.
