    The problem you have is that the debt is in your name so it is your debt.


    What does your relative have to say in all this.

    What you should have done was inform the lender of the suspected fraud as soon as you were aware of it.

    It's a bit late to have waited until they sold the debt on and those debt collectors have now summonsed you. You now either need to pay up, agree to pay up or defend the claim against you, in whole or in part, as described on the summons.

    Or you could just ignore the summons too. :cool:

    Just seems a small amount to be taken to court for, was it a creditcard, loan, catalogue debt ? they usually just pass them around DCA`s if no payment, to take to court suggests maybe a council tax debt ???

  • Hi guys thanks for all the advice. I have not informed the relative yet about the summons. Yes it is genuine and from my local sheriff court. The debt is from arrow global acting on behalf of shop direct.

    Then you need to pay the debt. You don't get to shield them from the consequences, and not take them on yourself either.

    Of course, if they pay it back for you, including costs, then all will be well.
