Deduction of wages

HI all,

I left a firm within my trial period and I was sent a letter the same day confirming I was entitled to a weeks pay.

I was then notified that this weeks pay was subject to deduction of over compensation of holiday pay and measures have been put in place to recoup monies due to 'inappropriate management decisions' I was 'allegedly' involved in.

Is this legal?

I have asked for a full working out of holiday entitlement, the full details of the alleged inappropriate management decisions and the clause in my contract stating that any final offer of money is subject to deductions.

Just wondering if anyone had any views....

    I think you've done all you can, for now, but let's just check:

    how long did you actually work there for?
    did you take any holiday in that time?

    I left a week before my 3 month trial period ended, and I took the holiday that had to be kept for xmas. I had only had 2 days accrued, and needed 3 for xmas, so one of those was unpaid. And I had a day off for my nan's funeral, but I don't believe that was counted as holiday....

    Well, you might find that even if they didn't say at the time "you'll have to take that as holiday", they've decided to take that day for your nan's funeral out of your leave entitlement.

    What's the holiday year and the holiday allowance? (include bank holidays)

    how many weeks did you work?

    there have been 3(xmas,BD,NY) Bank holidays did you take those?

    3 months would have 7 days so you are probably around 6.5ish

    If they did not pay the 3rd day at Xmas you are around breakeven/owed with the funeral day as holiday.

    Hi, re you query.

    1) Based on your evidence it is not possible to offer a firm opinion re the legality of the alleged wage deduction. Ultimately, only an employment judge can determine whether a deduction is lawful.
    2) I would urge you to call ACAS on 08457 47 47 47 or 0115 9002670. They will be able to offer you some helpful guidance and if you provide them with sufficient detail they may well be able to answer you query.
