hi all
hoping can get some advice , any at all would be great...
for the last 10 years huby has paid regular csa payments.... but have built up arrears over time due to lapses in re assesments and the csa telling us to pay what we can afford, which then works out to be too little....
anyway last year hub changed jobs and we did the reassesment and was paying and we have only missed 1 months money on the new assesment and we received a letter today saying they taking:
£248 per 4 weeks for csa pament which we know is law
then a further £247 for arrears
through a deductions of earnings order...
the last contact the csa made with us was december 23rd stating that we needed to pay 54 and they would contact us regarding the arrears... since then we have heard nothing until this deduction of earnings order ........ surely that cant be right...
Do they have the right to do a deductions of earning order with out calls or letters?
there is 3k worth of arrears because when we went from jsa to working it took them 9 months to reasses the case plus other times of wages going up and down and waiting for assesments which take months
any advice would be greatful as they due to take first payment from wages on 28th
thanks in advance

So from what we read , nothing was paid for 9 months?
So 36 weeks * £59 =£2124, you perhaps could see if the arrears are spread over a longer period (this could be difficult if the NRP is often in and out of liability) you probably have more chance of winning a jackpot lotto than the liability being written off.0 -
hi thanks for the reply.......
no over the course of the 10 years ive been with my hubby he has had 4 jobs where income has been different so we asked for reassessment and we have paid what we could afford as told to do so by the csa... then its taken them that long the arrears have built up....
not trying to get the arrears wiped... was asking if they can just do a deductions of earning order as and when they feel like it..
we are going down to c.a.b tomorrow as half the information we have compared to what they have on there system is wrong....
we know we have to pay the csa for his children... just asking if there ethics are right thats all
but yer i guess your right ... better chance at winning the lottery than sorting this mess out0 -
A DEO can be issued following a missed payment.0
