how much will they take out of my I/s for ct bill?

I have recently separated from my ex and am now receiving I/s
I've recently found out that he had not been paying council tax for a year (one month was paid so about £1000 is owing)
I wrote offering £30 per month about 2 weeks ago but received no reply. I was think about having it taken directly out of my I/s
does anyone know how much they'd take? I get about £120 every two weeks

£3.60 per week (its a fixed rate) but it's at the council's discretion as to whether they are willing to accept an attachment of your benefit.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0 -
thanks how do I go about setting this up? I've never been on benefits before also am I responsible for the whole bill or half as it was I both names0

If the debt was accrued whilst together you will be joint and severally liable until the date you vacated based on your permanently moving your address
The Council have the choice to chase you both for the debt but once action has been instigated against one of you it stops the other having action taken against them at the same time. If your ex partner is working they will most likely go after them due to the size of the debt either via attaching his earnings if working or instructing bailiffs
At £1000 or so it is highly unlikely they will agree to making an attachment on your benefit as this will take years to pay off and if they refuse the offer of £30 this is a clear indication that this is the stance they will take
You need to sort this out quickly as instructing a bailiff is going to increase in cost on 6th April increasing any debt. If your ex partner is working and employed you may be best advising the council where they work if you cannot discuss it with them to sort out an improved offer otherwise they will most likely come after you and most likely instruct bailiffs
You cannot insist the council accept a deduction from benefit which they will only use as a last resort and it is they who request it if they do and is not for you to organise
ACT NOW. Ring the Council up and discuss it with them
