Advice re: Robinson Way chasing an old CCJ

Hello all - I'm new to these forums and would appreciate some advice!

Back in 2007 I defaulted on paying a store card (Dorothy Perkins/GE Capital). It was just after my son was born and my father was terminally ill. After his death we moved house - so in the confusion of those months the whole thing went out of my head and I never knew they had taken me to court and I had a CCJ.

I never needed to check my credit file - I (thought) I had a good financial history and had no need to borrow any money or apply for a mortgage or anything - so it wasn't until 2012 that on signing up for my report after it was flagged up by a letting agent that I discovered I had the CCJ. By this point it was 5 years old and I'd had no contact from anyone in the intervening time so I decided to just wait for it to drop off my file, which it duly did in September 2013.

Fast forward to today and a letter from Robinson Way (also mentioning Howard Cohen, CL Finance and HPH?) implying I have an outstanding debt that they now own. There are very few details but the amount is similar (although not identical) to the CCJ amount.

I have no other debts and have just re-checked my credit file and there's nothing on there. I'm very wary of entering into any kind of correspondence with Robinson Way without getting advice first!

In summary: the amount doesn't match, the CCJ is over 6 years old and they've provided no information about the 'debt' other than saying they own it and it was originally with GE Capital.

Suggestions?

    Possibly statute barred.
    Send prove it letter.
    They are trying it on.

    Rob way will not know it's been ccj`d, they are rubbish.

    Send a prove it letter, and see what the response is. Don't do anything else at this point.

    Knowing this lot, they will send a holding response, then another, n a BIG discount to settle the debt.

    For now, send the prove it letter.....then wait.

  • Is that OK - to say I have *no* knowledge of the debt when I think I probably do know what it relates to?
  • I definitely don't have any other debts!

    There is nothing I can see listed on my credit report and is not for exactly the same amount as the CCJ (which included charges) or the original defaulted amount. It's in the same ballpark and is listed as GE Capital so I honestly don't know what else it could relate to.

    This is not something I have ever had to do before - its been the only slipup in a pretty blameless financial life!

    You have no knowledge of owing Robinson Way anything.

    Under the Limitations Act 1980 a creditor has six years to chase most unpaid debts, or twelve years for some mortgage shortfalls. This ‘limitation period’ starts from the time of your last payment, not the total length of time you’ve been making payments. If a court judgment (CCJ) has been registered against you before the limitation period has passed it can be enforced at any point. There is no limitations period for a CCJ.     They are not even sure this is their debt yet so makes sense to make them prove what it is. Even if it is the CCJ debt RW are likely out of time to enforce it without special permission of the course. RW would have also bought this for a tiny % of the face value.
