Barclaycard and MKDP LLP court action

Hi, I have just received a county court claim form from MKDP LLP taking me to court for £8000 owed to Barclaycard. I know I had this card years ago but can't remember how long ago and if and when I paid it off. I don't EVER remember having a debt this big at all!!! Anyway this is the first I have heard of this debt and have had no correspondence from B/card or MKDP whatsoever. I almost fainted when I opened it up. Can anyone advise me as to what to do please? Worse thing is I go away on Monday for 3 weeks so don't have a lot of time. I'm kind of freaking out over this. Please help me.

I would suggest you defend it on the basis that its not your debt.

If it is and you haven't paid anything or acknowledged the debt in writing for 6 years then its statute barred and that's a complete defence.

If its yours and not statute barred, you need to put in a CCA request as if its taken out before April 2007 they need the signed original to get a CCJ.

I'm no expert of the courts, but thought i would chip in as no one else had.

Make sure you defend it, make sure you reply otherwise you will get a ccj (which is what they are hoping).
    Reply asap.
