CSA1, wait to migrate to 2012 scheme, or reassess now.

Hi all,

Newly registered but been reading these forums awhile now, hopefully someone can help me.

I'm the NRP, and have been on CSA 1 since 2001. I have a voluntary arrangement with my Son's Mother where I pay her £240 maintenance each month, this is paid 'cash-in-hand', as it will effect her claim for Child Tax Credits otherwise, so I'm assuming she isn't declaring the maintenance as income.

She opened a case with the CSA in 2001, and it took some considerable time and bartering before we came to a compromise on the amount to be paid each month. This was based on my earnings at the time which averaged £6-700 net per month. 5 years ago I had to change jobs due to a medical condition, and now earn approx. £225.00 net per week.

The case as far as I'm aware is still open ended, or at least it appeared that way after I called the CSA a few months ago, so I'm assuming that even though we are on CSA 1 rules, and have a voluntary arrangement for the payment of maintenance, that sometime between now and 2017 I will be moved to the 2012 Scheme rules.

So, my question is, do I wait to be reassessed, or call the CSA with a view to reassessing now, as £240 out of £900 per month is basically skinning me alive. OR, can some kind person tell me how to calculate what I would potentially have to pay under CSA 1 rules with a new assessment.

There are no other children involved BTW, and I am not in a relationship, any other info needed just ask.

    Best thing is to ask the CSA to reassess. The money you give her would not affect her tax credits claim etc as CM is disregarded.

    If you request a reassessment now it will be based on 'old rules'. Could you not re-negotiate a lower payment with the PWC? I can calculate 'old rules' liabilities.

    There's no negotiation with her, I've tried, and it falls on deaf ears .. in fact she actually thinks I should be paying more, as "It hasn't gone up in years" Of course she forgets that the current amount I pay was based on a wage nearly three times what I currently earn!

    This is why I'm thinking of having the CSA reassess, even on CSA 1 rules I can't be worse off, or can I?

    What I'd really like to know though, is if my case will (eventually) be migrated across to the 2012 scheme automatically, or whether I need to 'kick-start' it so to speak, with it having remained dormant so long.

    In her defence,what you are paying is rather low for the wages you received at the time you made the arrangement,so you've had a good deal all these years!

    Nothing you do will 'kick start' migration to the 2012 scheme - it will eventually migrate following a programme determined by the CSA.
    You will need to pm me a whole host of information - income, housing costs etc
  • There's no migration to the new system as such - all current cases will close over the next 3/4 years, and the case participants will be given the option of either opening a new case on the 2012 system or coming to their own arrangement without CMS involvement.
