How long before discharge?

Hi everyone

Can you help, we are trying to find out how long it takes for discharge as we are going to emmigrate on a highly skilled migrant application and have been told once discharge has been received it should be ok. I have heard about people being discharged after 6 months.. can people tell me their experience please we so desperately want to get away from this country.

    Hi Molly,

    If this is your first Bankruptcy you are usually Discharged after 12 months.

    However, you can be discharged earlier than this. This decisions is ultimately down to the OR so you would be best contacting them so see if you would be discharged early.

    Everyone will be discharged twelve months to the day of your BR, but in some cases they get early discharge after about 6 months.

    I was discharged 6 months & 2 days after bankruptcy. My case was pretty straight forward, debt was made up of credit card, loans, catalog etc. I did not own a business or my own house. Every case may differ. But I do know a friend who had a case similar to mine and she was also after 6 months.Good luck.

    Automatic discharge will be 12 months to the day.
    However if you are a good little BR and cooperate and havent got a mattress full of goodies to distribute, the earliest ED I have seen was just over 5 months. Mine was 7 months

    By what I can gather, and from the cases on the board, I have noticed that if you dont have property its about 6 months. If you have property that needs to be realised, it is the bog standard 1 year.

    I have just finalised all my property stuff (a family member bought out my share) and I am 7 months into my bankruptcy. If they were to start early discharge now, it would only discharge me 2 months prior to the automatic discharge, so not really worth their time to do it. Still, i live in hope though.

    My case was straight forward and i was discharged after exactly 6 months .

    You should recieve a letter and a new IPOQ to fill in this starts the early discharge procedure .

    I received my early discharge two days less than 6 months into my bankruptcy - although I did not receive the letter until 3 weeks after my discharge date. It pays to keep checking the Insolvency Service Website. As a general rule - if your name does not come up, then you have been discharged.
    I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
    If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

    I had to speak to the OR this morning and they pretty much confirmed that I won't be getting an early discharge - so roll on the 10th December.

    Thats a shame, backontheup, but I genuinely think the time will fly by. At least, thats what I'm telling myself as I have another 8 months until automatic discharge.

    Strange that, backontheup, I have property and was discharged after 6 months. However - a trustee was appointed in my case, and the property issue is still ongoing.
    Just shows how inconsistent BR can be.
    I didn't expect an early discharge, but was not going to refuse it.
    I hope you get a nice surprise, too.
