missed two payments, already getting visits :-(

Hi all,

Since February I have stopped paying creditors as I had more money going out than coming in and needed to get funds together to be able to rent as we are voluntary terminating the mortgaged house.
Now everyone of the creditors have sent an odd letter, and northern Rock haven't sent anything, but blockhouse have sent numerous letters, and I have just picked up the post from the old address and found I have missed 2 visits ( 1 each of the last 2 weeks), asking me to contact them for a solution.
My question is, I am worried they may get a ccj against me before I declare bankruptcy. Is this likely in the 6 weeks I have left ( I have no clue of timescales for this to happen), and if so, what do I do?!
Just really worried at the moment and May can not come quick enough.

    Priorities;


    Get re housed - so use all available monies to make this happen
    and then
    Go bankrupt (if advice received suggests this)


    Certainly, nothing bad is likely to happen in next 6 weeks, and even if yu did get a CCJ, it's effect would be cancelled by your bankruptcy.

    Thanks for the reply.

    Yeah spoke to stepchange end of January and they advised bankruptcy.
    Moved into rented accommodation last month so now it is just a case of getting money for fees.

  • very unlikely to get a CCJ in 6 weeks, also most DCA's don't like going down that route as they can no longer keep loading on there "think of a number and double it" charges, if they do make a door step visit on you remember they have absolutely no powers of entry, take anything or harass you, if the refuse to leave your property call the police or start watering your garden from an upstairs window, tips for dealing with them;


    Open the door naked with a bobble hat on, seems to make them cut their doorstep visit short.


    When they ask in phone calls or on the door step for "security checks" ie mothers maiden name, ask them your security questions back, ask them anything, my favourite was "in what year was the 1966 world cup final" if they get it right just say "sorry that doesn't match my records" and hang up.

    No need to worry about CCJ's, given the course of action you have decided to take to deal with your debts.

    Do exactly as Debt Doctor says.....whilst you are about it, make sure, ASAP, you have opened one or two basic bank accounts with either Co-op [CAshminders] of Barclays.

    [With Co-op, do not mention [or deny] anything about your intention to petition bankruptcy!]...

    [Co-op allow retention of internet services [now quite good] throughout the Undischarged period..Barclays official policy is to cancel internet access through this period]

    Open two accounts..one for incomes and general casual spending, the other for fixed bills, DD's, SO's, etc.....which one doesn't touch at all...easier for budgeting when times apparently get difficult?

    Open three, so one can be used for 'savings?'

    Get the above all done before you do anything about bankruptcy!

    Once you are moved out of your property into a decent rented home....there is no rush to petition bankruptcy...the most important step in BR being, making hte decision first...after you've done that, you are 'untouchable'.....with nothing to fear from creditors, much as they stamp and roar at you!

    Fermi [of this parish] has a letter template somewhere on here, you could send to creditors informing them that you will ONLY communicate via letter, and by no other means.....this effectively makes phone calls & doorstepping a no-no!

    If anyone does try the CCJ route..attend with your SOA [and the above letter, with proof of posting....in case the creditor claims you have been uncommunicative?].............so that the Court [if you agree the debt exists?]....can set a reasonable repayment regime [which will upset the creditor, as it won't be anything like the amount they want to see].......?


    Since you won't be paying anything anyway, pre-BR petition, [one cannot favour creditors pre-BR, remember]....the creditor concerned would have to return to Court at least twice, to get an enforcement order, which will cost them dearly....by which time you will be well ready to petition?


    I suggest also, with any unsecured debts you have, of simply making a token payment to each creditor.

    This could simply be, one pound a month to each....paid whether they agree or not.

    Pay by a method which allows an evidence trail [via bank, using internet is good] ....or cheque if you still have that sort of thing running...

    The purpose of this process is ........should the need arise.....to demonstrate to a Court [at a CCJ hearing] that you have the intention to pay.

    This act would incline a Court to look favourably at you rather than the creditor when setting an amount to pay.

    Make sure it is the same amount to each creditor...this is important as it complies with the rules surrounding Bankruptcy.
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......
