But the employer only changed in name this was a TUPE transfer. The employer issued the P45 with one hand and received it with the other, it would be a paper only exercise and they got it wrong and it would have been obvious.

A change of company name wouldn't require a TUPE transfer.

Reading through the post the OP said " I had same job but different location/emloyer."

I have. Not the employers responsibility though. P45's are issued to ex employees not to the new employers.

    Not necessarily with a TUPE

  • Thanks for all the responses I guess there would be not a lot I can do but pay the debt.

By the way we did not receive p45's as it was a tupe process, and I didn't investigate at the time due to the information given in the p60, as the p60 incorrectly stated previous employers pay, sure I thought my tax was a little lower and put that down to increase in tax code.

Will contact hmrc and explain the situation and I will see if I can pay it off interest free for the longest term possible.

I guess this is just one of those things where ships happen!

Just do that, don't start negotiating on paying it off.
Before you go print out and read the content of the link in post 5 and make sure the HMRC employee knows you are referring to this.
Your new employer definately made a mistake and should have known.
You certainly have a chance, it is not all hard and fast with HMRC, they do negotiate.
