I hold power of attorney for my grandmother which allows me to manage her accounts etc. It doesn't stop her from also managing her accounts. She can still apply for loans etc and I do not have to be informed, but I can also apply for loans in her name etc and manage her bank accounts.
My point is that there are very few (if any) orders which prevent someone from making their own decisions. The bank may have a problem if they entered into the contract knowing that the OP's son didn't have the mental capacity to understand what he was agreeing to. The fact that they have been told may be enough to prove this. But it depends on how the loans were given. If he walked into a branch and seemed completely aware of what was going on then it may be fair for the bank to think that the situation that existed years ago no longer exists.0 -

Are your son's learning difficulties obvious?
Why do you think the document you have says he is not allowed to manage his own finances? What is this document (there is no need to keep it a secret).
Why did the FOS reject your complaint?
If your son moved his account elsewhere, what's the worst that could happen if he didn't repay?
(You have recourse to the courts, but could perhaps do with a more constructive approach if you expect to convince a judge that you're not just a wild eyed loon).0 -
From your other thread.My son is registered disabled. I act on his behalf in any financial matters because he does not fully understand them. I wrote a letter to Lloyds TSB in 2010 bitterly complaining he had been charged £30 by an error. They were left in no doubt I was responsible for my son's transactions and had a legal document (although not a lodged power of attorny) to verify the fact.
No proper legal document, no deal. The banks will deal with your son, not you.
It doesn't matter how 'legal' the document is or looks, without the seal of the Court of Protection it's worthless.
You need to apply to become a Deputy of the Court of Protection as it sounds like your son doesn't understand enough to sign Power of Attorney forms.
