self assessment fine

really need some advice please. my dad has received a £100 fine for not returning his self assessment back so today I've rang the HMRC and explained that due to a serious stroke he is unable to talk, write, read, walk, feed himself or even wipe his own backside plus he is terminal with stomach cancer but they just don't care and have told me that unless they get a letter from him and signed by him the fine will stand and will increase over time.

I then told then that i am an Appointee for him with the DWP and could prove that with the paperwork i have but as yet i don't have POA over my dad as it has do go through the courts which will take time but again it was a no and they insist on a letter from him.

what can i do ??

    Make a formal complaint.

    This sounds like a situation where speaking to the press might help, they won't like the adverse publicity.

    I've previously had the fine rescinded because I didn't owe anything. Is anything owed in this case?

    That no longer applies, the fine for not sending in the return now stands.

    OP, write to your MP and get them to do a bit of work and write on your behalf, explaining the situation. Should do the trick.

    Mozette many thanks never thought of that and the MP is a old family friend and I've just emailed him. finger's crossed
