I have no problem with this as I won't dispute the arrears, just their handling of it, as I would like to be able to sell and pay them off asap

Even if NRAM get a Court Order, you can still sell the property, and pay off the mortgage in full.

If you put the property up for sale now, when you attend the court hearing, you can advise the judge that the property is on the market. He/she may then consider issuing a a possession order suspended upon full repayment of the mortgage after a set period of time, for example three months. Only after three months would the NRAM be able to apply for a possession date. When they apply for a possession date, this takes a little while, and the possession date normally isn't immediate, it's usually a few weeks later.

So you still have time to sell the property, re-possession isn't yet certain. From NRAM's point of few, they want to proceed with their action, so their security isn't adversely affected.

When you attend the hearing, be calm and factual- the judge won't be interested in anger and blame.

Hope this is of some help.

I am going to contact the CAB this week, and get advice from my union's solicitors (I get a 30 minute free phone consultation)
