Overpayment after leaving job.

I left Marks and Spencer last year in October. My pay was consistently messed up throughout my employment, with me not being paid for July or August. Pay at M&S was supposedly 3 weeks in advance and 1 in lieu. I had handed in my two weeks notice, worked my final shifts, and left. Then about 3 days later went in and collected my wages in cash and received a letter a month or so later stating that I owe the company an overpayment of £334.02 I'm 19 years old studying at sixth form with no regular income, I have written to M&S several times as well as phoning, I either get vague, hasty responses or they ignore my letters or have nobody available to take my call. I then received a letter from their solicitors (before getting any response to my email from them) demanding my money and claiming they will have to take the money from me if I don't pay up. I feel as though they are just trying to bully me for my money, any advice will be greatly appreciated!!

But it's not your money, you were overpaid and you have to pay it back. Sorry for sounding harsh but if you were paid too much then they have very right to ask for it back.0

Did they explain how the overpayment came about.
Have you worked out that they have overpayed you and you agree.
If so, you really don't have a choice but to repay it.
Offer a repayment plan of so much per week/monthmake the most of it, we are only here for the weekend.

Be careful that they don't pass on the debt to a debt collection agency and you end up getting a default.
Your credit will be trashed for the next six years, just at a time when you will probably need credit.

They have to go to court to do that.0 -
Write the solicitor that M&S(and copy M&S) have yet to provide you with the proof needed to make the claim for overpaid wages.
Do your own calculations of what you have/should have been paid and submit those with the letter
I do hope you kept the records of your hours, what you have been paid and all your pay slips
Once you establish the overpayment if any then you can negotiate a payment plan.0 -
