You seem to be confused
You can either prove they are counterfeit OR send them back to the seller.
Not both.
If you cannot gain the evidence they are counterfeit then you MUST send them back to the seller in order to be refunded.0 -
I am not confused in the slightest. If I gain proof that they are counterfeit Ebay will refund me and I will dispose of the items in the way Ebay wants me to as per their terms:
If a buyer suspects that an item is counterfeit and there are strong indicators that the item is counterfeit, the buyer isn’t required to return the item to the seller. The buyer agrees to cooperate with us to ensure the proper disposal of the item. In such cases, we refund the buyer for the full cost of the item and original postage, and the seller reimburses us for the refund. The buyer may not sell the item on eBay or elsewhere.
If I cannot get proof that they are counterfeit I have to pay the return postage which I do not wish to do as this is more than the fact that I simply do not wish to keep the item they were completely misrepresented in the description and they also break the law.0 -

OP if you have proven they are fake you cannot send them back to the seller...you have to destroy the dvd's and send the proof to ebay for a refund. Also as already said if you can't prove they are fake and want a refund, sending them back enter the tracking number into the resoulution centre and Ebay will refund you.0 -

I only said that HMV and my local police wont provide proof, I wondered if anyone else had any idea of where to go next ad some people on this thread have offered me ideas which I am following up on. I have spoken to ebay who have placed the case on hold for me until I get some proof from somewhere.
Ebay have already said they will not cover return postage if I cannot prove there is more to my dispute than just not wanting the items I have to prove they are counterfeit or I will be liable for return postage which I do not want until it is the absolute last resort, I don't want to be out of pocket because someone else decided to break ebay's rules and the law.

Forget what they've told you, it's automated and it WILL time out. Providing that you are not sending the goods overseas, the only counterfeits that it is illegal to send through the post are postage stamps and currency.0 -
