Apologies I forgot to include that I have tried to get in touch with trading standards through citizens advice who have told me that there is a five day call back procedure but they cannot guarantee that they will call me back to help with my problem. This was when they suggested going to a police station or retailer.

If they don't call me back I fear I may be out of options :(

Are these for your own use? Have you seen them playing, is the quality good?
If the answer is yes to the above then enjoy the free dvd's and your refunded money.
I would get counterfeit over high priced original anyday

They are for my own use and as I mentioned above the quality of many of the episodes are as if they have been recorded from TV and transferred to disc, they are most certainly not brand new as the listing described. The DVD's are not free as the seller still has my money and I cant get it back until I prove they are counterfeit. I paid not too far off the cost of what they sell for from online retailers and they were listed as brand new not counterfeit otherwise I would not have bought them.

I am unable to contact the seller now as the case was automatically escalated due to his lack of response and I have already left feedback for him.

I worked out return postage thinking of royal mail recorded delivery, I never thought about using a courier service but I would like to avoid any cost to myself as these DVD's are clearly fake. The box and disc art is noticably faded and the colours look wrong and some of episodes appear to have been recorded directly from the TV.

Ebay are being quite vague when I am speaking to them and seem to be sending me to places that cannot help, one person sent me to an anti fraud website who said they will not help and someone else said go to the police even after I explained the police would not help.

Cases do not get automatically escalated. They are escalated by the buyer or the seller.

As it is now escalated, you will be asked to return them. You must do this via tracked method.

Ring Ebay and ask them to supply you with a returns label with tracking.

Then return them, stall and you will lose the case as it will time out after escalation.

The case was escalated without my request by a member of the resolution team I was speaking to the night before the escalation happened. As I said in my first post I cannot send the items back without proof that they are counterfeit or ebay will not refund my money.

They can't keep the goods and get a refund, to get a refund Ebay with require proof the DVD's have been returned to the seller..

Have you actually asked the seller if they will pay return postage, under the circumstances they maybe prepared to pay. And at the moment you only suspect they are fake, until they have been proven as fakes you can return them to the seller as a SNAD...input the return tracking number into the resolution centre and you get your refund.

TS could take a while to get back to you and may not be able to help...the only other way is to contact the authentic DVD distributors and let them deal with it..they will authenticate them for you but it could take a while, and will open a whole can of worms up for the seller.

If they are obvious fakes, like covered in Chinese writing, wrong region, poor print, it should be relatively easy to take pictures of this and send them to eBay as the evidence? I too have received fake DVDs and it's not normally rocket science to spot it.

I didn't think Ebay except photo's as evidence?

I don't know but it seems crazy going from place to pace when it's so easy to tell?

Totally agree, counterfit DVD's usually come with substandard, if the were sealed as seller said in the description they still should of been recognisable as fakes.
