Lowell Portfolio 1 Debt Proof

Hi all first post here but I have been reading up on other topics for a while...

I finished of my IVA last May 2013 and have my Certificate of completion.

But three weeks ago I received two demanding letters from the above company. So I sent them the I don't agree or acknowledge the debt and prove it letter. So fast forward to today and I get the letters and proof of the debt.. But it turns out and I knew this. They have brought a debt that was part of the original IVA and I have all the account numbers listed they provided as well. This is now closed and finished

So what I need to know. Do I send Lowell proof of the IVA closure (photocopy of my certificate of completion) and it's now their problem not mine. Is their a template letter I could doctor and send off to them to this effect.

Any help and advise will be appreciated..

    This one covers debts included in a bankruptcy.

    Could be easily adapted to suit an IVA by replacing the terminology to suit and a bit of tweaking.

    I would also contact your IP or supervisor. They will probably be able to write to them as well telling them to back off.

    Also check your credit file to make sure that Lowells haven't put defaults on there that are wrongly dated or say they they are still owed.

    Fermi, thanks for the fast response...

    I have looked at my experian credit file and see Lowell have been snooping around in their. I also called my IVA company up to get em on the case as well, so just getting all the info I can to throw back at Lowell....

    I sent off the letter be it adapted to Lowell, but they then chose to ignore this and send me letters from a company called Red now (believe part of them as well) saying they will want the money. I received another one yesterday from RED saying if I pay 70% of the debt.. LOL

    I sent in proof be it marked all else out apart from the items they say is owed by me. and clearly shows these where part of my IVA.

    My IVA is now cleared off and i am debt free, aprt from these letters from Lowell as they have brought the debt but this is quite clearly a null and void debt being as it was part of the IVA.

    I am after help and any assistance as what letter to now send them to say back off and leave me alone. Its more of a pain now sorting this out and proving to them they are useless and have the wrong details.

    Anyone hellp me on what to send them now???

    Call the FOS and ask them to write to them and/or take the complaint on.

    Have you IVA supervisors written to Lowell as well? They should.

    They will be in deep doo doo if they continue to pursue this, let them make fools of them selves, then get some compo from them via financial ombudsman, you are 100% protected from them, have some fun :rotfl:!!!!!!!!

    Right a little update here. Just been on phone to Experian, very helpful and sending letter to Lowell say go away and get details off my records.

    Also raised complaint with FOS and they will be sending them a letter of complaint and remove all details.


    So let's see where this now goes and what Lowell/Red or whatever decide now.. It's been a pain to spend time sorting this and letters off to them, but this site has been a really great help for advise and what to do. Anyone else don't feel intimidated by them, I did a bit but hopefully now I can get rid of these parasites from wasting trees sending me paper demands...

  • Right another update. received confirmation letter today from FOS about them sending in a complaint to Lowell.

    Nothing heard from Lowell as of yet, but they have time to respond back.

    lets see what happens now.

    The FOS might even get some compensation for you to cover your time and expenses and massive inconvenience.

  • OK big update time and its good news :beer:

    Received letter today from Lowell Group, Paul Ochiltree, Customer Relations officer.

    So now to the good part.

    Lowell brought these accounts i disputed in good faith in the belief that the debt was due and owing. they where not aware I entered into an IVA and these accounts where included in this. As in fact they brought the debt after I have finished my IVA. They thanked me for all the info I sent onto them referencing my IVA and why I disputed the accounts. So as a result of this they confirm that they have now ceased all pursuit of these accounts and closed on their system. All details of Lowell Portfolio 1 Ltd will be removed also from my Credit files :j

    and the best bit is....

    They are sorry for any inconvenience I may have been caused and offering me £100 compensation.

    They also enclosed the copy of the letter they received from the FSO.

    Also I have sent on details to the original Bank that the accounts where part of my IVA that they agreed to to get them removing the marks on my credit file at Experian. this is following Experian taking up this part and sending details onto me saying where I should send in proof of my IVA completion certificate.

    just awaiting on that news.


    So all in I'm happy now, but it was stressful receiving the demands and letters. In all this I never once called Lowell by phone and this site has been a brilliant help in advise and templates to use. if anything, anybody else who get these type of demands should stick to their guns and demand proof and ONLY deal with them by letter. and keep all notes and provide them with details of why you dispute the claims.
