A few years ago I went self employed for a short while. Never having any experience of being self employed I was advised to get an accountant to deal with all my paperwork. I was told by him at the time that he would do all the forms and he told us to pay him the tax due which he would then forward to Inland Revenue. Being inexperienced at this we took his word as to how things were done. After all that was what I was paying him for. Anyway short answer is I payed my taxes that were due to him and he never paid them into Inland Revenue. Apparently it all went into his pocket, This is why he is now in prison as he done the same thing to many people. But this went on for about 5 years before I R caught up with what he was doing. He was sending in false accounts. Although he is now in prison this doesn"t help me

Revenue and Customs are not unreasonable in cases like this of genuine criminal fraud and will accept payments over time, but you do need any agreement you make with them in writing.

I've heard they're not unreasonable about situations like this as well. Surely if the guy is in prison there's police paperwork that will support your case? Do you have proof or paperwork from the accountant relating to the payments made to him (fraudulent or otherwise)? He must have given you some kind of paperwork indicating the money had been paid (even if it hadn't)

    Hi
That was just the reply i did not want to year. What you need to do is contact your local revenue office explain what as happened and ask them for time to pay, also only agree to pay what you can affourd(do not over stretch yourself)Also do not take out a loan under any circumstances to pay off the debt.I dont think you will have a problem with the revenue agreaing to your proposal.Secondly you need a form of the IP to submit your claim against your ex accountant as you are a creditor. But you will find out that there will be very little funds available for any creditors.
    Good luck

    Hi Again
Having just read your thread again,If you were self employed and he was subbmiting accounts in at the end of your financial year how was he calculating your tax that you were paying him(was that weekly, monthly or yearly.Sugnificant point here,If he was (as you said)sending in incorect accounts how can anyone say that you owe 5k,Remember just because you paid him 5k for the tax he said you owed does not mean that that his the amount you owe,if you come back with the right answers there his just a chance we can get around this.Right back ASAP.
    kindest regards Danno

Lemony, I am so sorry to hear of your awful situation.

I don't know anything about this myself but wondered if perhaps you should post the same thing on the Tax board here, as there are some accountant types there. I received really helpful response to some questions from people on that board.

    Best of luck with it.
