    FOS dealing with 2 issues the ICO dealing with the other 2 DPA2005


    they have 40 days to reply to me i will post when i get an update

    It is the Data Protection Act 1998 and applies to personal data so:

    1. If it was a business account, it is not personal data within the meaning of the Act, and

    2. Most creditors terms and conditions give them the right to "assign" or sell the debt to a third party at any time, you should be given notice of it but not necessarily before the act.

    It seems to me that the data arguments are red herrings and you need to focus on the advice you were given.

    as i was a sole trader it counts as personal details and we have not been given all information under the DSAR
    they are allowed to sell on providing they give you fair warning which they didnt

    the personal debts we had been paying off from aug 2011 when i managed to get back into full time employ

    it had gone to the TSB collections in scotland they were the people we had been dealing with up to july last year
