claim advice

What happens in my situation. me and my wife took a loan out in 1999. with this ppi cover was purchased for me.
In 2001 I was forced to retire from work due to an industrial injury, many years later ( 2012 ) while looking for some paperwork we came across our loan agreement. and couldn't believe that I had ppi cover, I contacted Nationwide who we purchased the loan and ppi from to ask about making a back dated claim. after filling in some forms we received a reply stating that the policy was not misssold. ect ect. I had 90 days to make an appeal to them. during the next year or so I became unwell and had several hospital stays and was restricted to home life because of my back and leg problem and depression.
I eventually was taken in for spinal surgery in Feb. 2012 my wife in the mean time was looking after me and our son who was 6, she also had to work full time to bring in a sufficient income to keep the roof over our heads.

It was while I was recovering from my operation we decided to involve the ombudsman. we filled out some forms and sent them off. I also contacted Aviva who were the ppi providers and after filling in forms and getting doctors letters to back up my claim they. allowed me to claim back 24months which is the maximum. I would of had to return back to work for 6 months before I could claim again. But in my position I wasn't able to return to work and haven't worked since I was pensioned off. My latest medical states I have a 32% disability due to my back and leg movement and depression. Aviva sent me a copy of our agreement and after reading it I found that there are No provisions for someone who can not return back to work, There was a clause about death and should I die the loan would be wrote off. but here was I in a situation where I couldn't earn.
My Doctor also wrote them a letter stating its very unlikely id ever work again, Aviva despite my plea for help played everything by the book and only paid me 24 months back payment. and after a struggle agreed to refund my premiums from 2002 onwards

I feel really let down that the ppi policy hasn't got any clauses to cover my situation. and feel that it should of had. I expected the ppi cover to be suitable for my needs which it turned out not to be.

In the mean time I received a letter back from the Ombudsman stating that because we didn't respond to Nationwide letter ( with a time limit ) that Nationwide would not enter into discussions regarding my claim.

The ombudsman went in their favour despite me out lining the difficulties we were having at that time and that my wife had higher priorities to deal with.

So basically I am left in a situation.

I had proposed to Nationwide to help me as this was a genuine cry for help. I couldn't help I was injured at work. I also couldn't help that I didn't respond to medical help. It wasn't my fault I couldn't work. I asked Nationwide to consider writing off the loan, but didn't get a response from them. I also asked for Aviva`so help because of my long term situation but they kept by the book.

I felt all it would of taken is some Empathy from both of them to recognise that I was a genuine case and that both could of discussed a solution to help me. Ive find Nationwide comes over as having a very closed mind without any options for discussion.

Im sure there are many more people in the same situation, and have no where to turn.

what can I do.

    I don't think there is anything you can do. PPI typically does only pay out for a limited period (in your case 2 years) and Aviva have paid you that and also refunded your premiums from 2002. The PPI was suitable for your needs at the time you took it out, unfortunately your needs changed.

    Is the loan still outstanding or has it been repaid? If still outstanding, how much do you still owe?
