Hi Folks,
Just a quick one. I have today (as registered keeper) received a PCN from ParkingEye for the Park Inn Heathrow where the driver was having a meeting (no payment receipts).
There were ticket machines in the car park area that are used for purchasing parking tickets that do not require any registration information entering, yet they are issuing a PCN based upon ANPR information, seemingly without having done any checking on whether a ticket was bought.
My thought is that pretty much nobody keeps their parking ticket once it's been used, so how can it be proved that a parking ticket was purchased by the driver? Or is it down to the PPC to prove that a ticket wasn't bought??
I'd be interested to hear your thoughts on how to word this in an appeals letter to the PPC...

As my original post says, I am interested to hear people's thoughts on ANPR usage where there are ticket machines and no way to seemingly marry up the ANPR and tickets purchased.
In particular, I feel that this could be a cornerstone of the appeal, along with the fact that a driver cannot be reasonably expected to keep all parking tickets issued by machines on the off chance that they will receive a PCN. It is my intention to utilise this in the appeal (and no doubt subsequent POPLA appeal) and am seeking advice on how others would word this.0 -
as you asked for opinions , here is mine
PE use anpr and they use vehicle reg numbers in ticket machines, so despite what you have said its the only method they can employ for checking the vehicles that are photographed have bought a parking ticket, so I am of the opinion it wont wash and I believe you are incorrect in how their system works, even if you disagree which you are entitled to do obviously
its never the case that people are told to keep them for weeks or months either, so generally any evidence is thrown away
in any case I do not believe you would be successful with this type of appeal, although you can certainly add it into your appeals if you wish to do so (as keeper)
the fact remains that generally any challenge is upheld on 3 key appeal points, not a gpeol , no contract and poor signage , I do not believe popla would uphold your appeal based on your story in post #1
best bet is follow the tried and tested route laid down in this NEWBIES thread https://forums.moneysavingexpert.com/discussion/4816822 instead of trying to trip them up using your version of this ticket machine idea , especially if you have no evidence to prove it0 -

Thanks for the information. I am aware that these ticket machines did not have registration information on them, which is why there was a query raised in my head about it!
I have included all the other mentioned points, and will include the ticketing point as well to see what kind of response it garners!0 -
Parking Eye - ALDI Margate use ANPR but have no barrier or machine for tickets. Just a fixed 1.5hr limit (driver unaware of this). However ANPR shows time of leaving (with photo sent with invoice) at 15:08 HOWEVER the till receipt for shopping shows 15:22? Interesting.0

You could have parked round the corner (or elsewhere) and returned to store on foot?0 -

Why would anyone in their right mind have to do that when visiting a Supermarket with a free car park (rhetorical question)! They never said they 'returned' either!

Hi folks,
As expected, Parking Eye have laughed at my appeal letter and issued a POPLA code.
I am a little confused as to where to go from here. I have had a read through the parking eye POPLA threads and whilst I am happy in principal with the next steps, I have some queries regarding GPEOL.
The thread at https://forums.moneysavingexpert.com/discussion/comment/63857139#Comment_63857139 indicates:1) No genuine pre-estimate of loss
This car park is free and there is no provision for the purchasing of a ticket or any other means for paying for parking.
For the car park in question, this is not accurate, the car park is not free and there are abilities to purchase tickets. Do I still lead with this line on my appeal or should it be re-worded?
Also, in effect, there is no loss to the company as the driver of the vehicle stopped at the hotel for a period of time, during it has been indicated that a number of rounds of drinks and evening meal were purchased. Obviously, this is income for the hotel where there could have been nothing. I did forward a copy of the bank statement of the driver with my appeal but PE appear to have completely ignored this fact.
Additionally, they've also started quoting POFA in the "FAQs" on the letter where no mention of POFA was previously included on the NTK, and the NTK was received outside of the 14 day limit set aside by POFA.
Some pointers would be appreciated.

The POPLA appeals thread, the NEWBIES thread all have excellent example of successful POPLA appeals.
My advice is use one of them as your basis of appeal. They worked before, so why not for you?

Either; I purchased a ticket and therefore there is no loss.
Or; The driver stayed x minutes and so the loss to the landowner is £x. There is no loss to ParkingEye.
As they have quoted POFA and this does not apply, this should be reported to the BPA and the DVLA as this is an offence.

I wish to raise a formal complaint about parkingeye.
I enclose correspondence from parkingeye showing they are attempting to state registered keeper liability applies. However, their NtK was served outside POFA 2012 timescales. I believe you previously warned all parking companies that stating keeper liability applies when it does not will lead to a bar from the DVLA keeper database under the KADOE contract.
Please ensure parkingeye are barred for the appropriate period.Dedicated to driving up standards in parking0
