county court letter asking me to visit them

    It sounds to me that you have an order to obtain information from someone who already has a ccj against you.

    If I'm right, you will be asked to complete an EX140

    There is a potential penalty of 2 weeks imprisonment if you fail to comply.

    I had something very similar happen to me
    I came home to a hand delivered letter from the county court bailiff requesting I visit the court the following day.

    A company that I owed money to had got a CCJ against me which was issued by default as I had not kept the creditor informed of my current address.
    The creditor went for enforcement by attachment of earnings but the court paperwork asking for income and expenditure also went to the old address.

    all the court wanted me for was to personally hand me the income and expenditure form.

    It could be that the are trying to enforce the CCJ by attachment and need to serve you the documents personally.

    The Bailiff I dealt with actually offerd to come back to my house to save me going to the court

    thankfully I am not a 50 year old man. about half that and female.


    if I comply and am honest I take it I am not going down lol? money is one thing but going to prison is quite another x

    You've got it.

    If I'm correct about what you have then you need to take a look at an EX140
    (my browser crashes for some reason when on the official site but there are other copies online) to see what you will be asked.

    Your responses need to be honest for the day you are in court.

    Bear in mind that the creditor will be looking to find out how to enforce their ccj, so:

    Do you work? If so who for, because they might apply for an Attachment to earnings. Not much you can do about that unless you want to give up your job.

    Do you have a nice asset like a car that they could ask bailiffs to take (warrant of execution)? They'll be asking for a registration number. Of course a car on HP, or one owned by a family member would be untouchable.

    Do you own property? They could ask for a charging order

    Do you have money in a bank account or other savings? They'll want the account number so they could ask for third party debt order. Of course there may be lots of good reasons to change bank accounts at any time, like the day after the court visit.

  • ok thanks for thereplies im a bit less worried now! my car is on finance and negative equity. asset wise other than that its basically the usual, white goods, tv etc nothing especially high end. I work so they can hopefully get an attatchment of earnings order at worst if needed.

    ill dress modestly and hope for a happy judge lol!

    IE11 is full of bugs like that. Many report it doesn't work with smilies, quotes and some other things here.
